Weekends and Holidays. If the date for the taking of any action under this Special Warrant Indenture expires on a day which is not a Business Day, such action may be taken on the next succeeding Business Day with the same force and effect as if taken within the period for the taking of such action.

CANCELLATION PENALTIES The Rental Company shall be entitled to compensation, not to exceed the lease payments for any losses the Rental Company may sustain due to your cancellation of all or part of any order. INSURANCE REQUIRMENTS YOU MUST INSURE ALL OF THE EQUIPMENT. Customer shall, at Customer’s expense, and at all times during the rental, maintain in full force and effect insurance covering all Equipment rented from all sources, for full replacement cost except vehicles which are at actual cash value and for the loss of use (rents) of the Equipment. Coverage must begin from the time Customer or its agents accept delivery of the Equipment and continue until the time the Equipment is returned. Customer shall deliver to the Rental Company, upon request, evidence of the insurance coverage, typically a Certificate of Insurance, satisfactory to the Rental Company, showing Liability Coverage, Property Insurance and Worker’s Compensation Insurance, prior to taking possession of the Equipment. Such insurance shall be written by reputable insurers acceptable to the Rental Company; Customer’s insurers shall agree to be the primary insurers of such equipment during the rental period. Notwithstanding this paragraph, Customer shall remain primarily liable to the Rental Company for full performance under the terms and conditions of the rental contract. The Rental Company may enforce its remedies directly against you without resort to Customer’s insurance. PROPERTY INSURANCE Customer’s insurance should be on a worldwide basis; shall name the Rental Company as Loss payee for loss or damage to the property rented; shall cover “All Risks” of loss or damage for Equipment ; vehicles physical damage coverage shall include the perils of “Comprehensive” and “Collision” and all policies shall provide for 10 days written notice to the Rental Company before any policy shall be modified or cancelled. Limits shall be sufficient to encompass all property at risk, regardless of source, but in no event less than $1,000,000.00.

If the date upon which any duties or obligations hereunder to be performed occurs upon a weekend or legal holiday, then, in such event, the due date for performance of any duty or obligation automatically will be extended to the next succeeding business day. However, any future dates that are dependent upon the date that falls on the weekend or legal holiday will be figured from the original date (rather than the date to which the original date was extended). By way of example, if the Inspection Period expires on a Saturday and the Closing Date is scheduled for the date that is 5 days thereafter, then the Inspection Period deadline will be extended to the first business day after Saturday but the Closing Date will occur on the date that is 5 days after Saturday.

Weekends and Holidays. One and one-half (1½) times the regular straight time hourly rate shall be paid for all work on Saturdays (except make-up day) and before a shift begins and after it ends. Double the regular straight time hourly rate shall be paid for all work on Sundays and holidays. On two shift operations, Laborers working a complete second shift of shift work on Saturdays, Sundays and holidays shall be paid eight (8) hours of pay at the appropriate overtime rate for eight (8) hours of work. For work on Saturdays, Sundays and holidays on a three-shift operation, Laborers working a complete second shift shall be paid eight (8) hours of pay at the appropriate overtime rate for seven and one-half (7-1/2) hours of work. Laborers working a complete third shift shall be paid eight (8) hours of pay at the appropriate rate for seven (7) hours of work.
