Common use of Waste or Nuisance Clause in Contracts

Waste or Nuisance. Concessionaire shall not commit nor permit any of its employees, contractors, subcontractors, licensees, subconcessionaires or agents to injure, deface or otherwise harm the Premises, the Terminal or the Airport, nor commit any waste upon the Premises, the Terminal or the Airport, and shall not place a load upon the floor of the Premises which exceeds the floor load per square foot which such floor was designed to carry. Concessionaire shall not commit nor permit any of its employees, contractors, subcontractors, licensees, subconcessionaires or agents to commit any nuisance or other act or thing which may constitute a menace or which may impact either the City’s operation of the Terminal or the Airport or disturb the quiet enjoyment of any other occupant or concessionaire of the Airport. Concessionaire shall not use or permit to be used any medium that might constitute a nuisance, such as loudspeakers, sound amplifiers, tape decks, compact disc players, radios, televisions, or any other sound producing or other device which will carry sound or odors outside the Premises except as may otherwise be approved in advance in writing by the Director and, upon notice from the Director to Concessionaire’s business representative at the Premises, Concessionaire shall cause any such noise or odors to cease immediately. Concessionaire shall not allow any use of the Premises or any other portion of the Terminal and/or Airport in a manner which is a source of annoyance, disturbance or embarrassment to the City, or to the other concessionaires and occupants of the Terminal and/or Airport or which is deemed by the City, in its sole discretion, as not in keeping with the character of the Terminal and/or Airport. The Premises shall not be used for any unlawful or immoral purpose or which will invalidate or increase the premiums on any of the City’s insurance.

Concessionaire Tenant shall not use or permit to be used any medium that might 61 constitute a nuisance, such as loudspeakers, sound amplifiers, tape decks, compact disc players, radios, 62 televisions, or any other sound producing or other device which will carry sound or odors outside the 63 Premises except as may otherwise be approved in advance in writing by the Director and, upon written notice from the Director to Concessionaire’s business representative at the PremisesLandlord, Concessionaire Tenant shall cause any such noise or odors to cease immediatelycease. Concessionaire 64 Xxxxxx agrees that business machines and mechanical equipment used by Tenant which cause vibration or 65 noise that may be transmitted to the building or buildings comprising the Park/Plaza Development or to 66 the Premises to such a degree as to be reasonably objectionable to Landlord or to any occupant, shall be 1 placed and maintained by Tenant at its expense in a manner sufficient to eliminate such vibrations or 2 noise, such as by cork, rubber or spring-type vibration isolators. Tenant shall not allow any use of the 3 Premises or any other portion of the Terminal and/or Airport Park/Plaza Development in a manner which is a source of annoyance, 4 disturbance or embarrassment to the CityOwner, Landlord or to the other concessionaires and occupants tenants of the Terminal and/or Airport Park/Plaza Development 5 or which is deemed by the CityLandlord, in its sole discretion, as not in keeping with the character of the Terminal and/or Airport0 Xxxx/Xxxxx Development. Concessionaire Contractor shall not use or permit to be used any medium that might constitute a nuisance, such as loudspeakers, sound amplifiers, tape decks, compact disc players, radios, televisions, or any other sound producing or other device which will carry sound or odors outside the Premises except as may otherwise be approved in advance in writing by the Director and, upon written notice from the Director to Concessionaire’s business representative at the PremisesAirports Authority, Concessionaire Contractor shall cause any such noise or odors to cease immediately. Concessionaire Contractor agrees that business machines and mechanical equipment used by Contractor which cause vibration or noise that may be transmitted to the building or buildings of facilities comprising the Airport or to the Premises to such a degree as to be reasonably objectionable to Airports Authority or to any occupant, shall be placed and maintained by Contractor at its expense in a manner sufficient to eliminate such vibrations or noise, such as by cork, rubber or spring-type vibration isolators. Contractor shall not allow any use of the Premises or any other portion of the Terminal and/or Airport in a manner which is a source of annoyance, disturbance or embarrassment to the CityAirports Authority, or to the other concessionaires and occupants tenants of the Terminal and/or Airport or which is deemed by the CityAirports Authority, in its sole discretion, as not in keeping with the character of the Terminal and/or Airport. The Premises shall not be used for any unlawful unlawful, immoral or immoral other purpose or which will invalidate or increase the premiums on any of the City’s insurancedeemed improper by Airports Authority.
