Common use of Warrantholder not a Shareholder Clause in Contracts

Warrantholder not a Shareholder. Nothing in this Indenture or in the ownership of a Warrant evidenced by a Series A Warrant Certificate, Series B Warrant Certificate or Series C Warrant Certificate, or otherwise, will be construed as conferring on a Warrantholder any right or interest whatsoever as a shareholder of the Company, including but not limited to any right to vote at, to receive notice of, or to attend, any meeting of shareholders or any other proceeding of the Company or any right to receive any dividend or other distribution.
