Common use of Warehouse Capacity Clause in Contracts

Warehouse Capacity. On or prior to the date on which Seller is required to deliver the monthly financial report required Section 14(g)(i)(A)(iii), Seller shall provide to Agent a report detailing its total warehouse capacity and utilization for the prior calendar month. On or prior to the date on which Seller is required to deliver the monthly financial report required in Section 14(g)(i)(A)(iii14(g)(i)(A)(3), Seller shall provide to Agent a report detailing its total warehouse capacity and utilization for the prior calendar month. Such warehouse capacity shall be (i) issued directly to Seller andor Guarantor and (ii) in an amount equal to or greater than $1,000,000 or such other amount as may be required by a Governmental Authority.
