13.02 In order to ensure operational efficiency, the Company reserves the right to limit the number of Employees permitted to be on vacation at one time in a manner which ensures that sufficient qualified Employees are at work at all times. In so far as operational requirements will permit, vacations shall be awarded on the following basis:
a) The preferred position in the selection and allocation of vacation periods shall be awarded on the basis of seniority as defined in Article 6;
b) The Company will post, no later than February 1st of each calendar year, dates for a plant shut down. The vacation schedule shall be posted by February 1st for the current year. Employees within each Department shall designate their vacation preference by seniority not later than March 1st. Employees shall not unduly hold up the vacation schedule. Employees who fail to designate their preference by March 1st shall not thereafter be able to exercise seniority to displace junior Employees from vacation dates already selected;
c) The approved vacation schedule shall be prepared by the Company and posted no later than April 1st;
d) Notwithstanding the above, the Company reserves the right to schedule all purposes be deemed Employees for up to bewages. For the purpose of definition, "Vacation Pay" means four percent (4%) or, after five (5) consecutive years days of employment, six percent (6%) annual vacation during a plant shutdown during the months of the wages or, after July or August.
13.03 Upon making application in writing not less than ten (10) years working days in advance, Employees shall receive their vacation pay on a date not later than the pay period prior to the date on which their vacations are scheduled to start.
13.04 If the employment of employment eight percent (8%) any Employee is terminated at any time after the commencement of their employment, the Company shall pay the individual, in addition to all other amounts due to them, any unused earned vacation entitlements.
13.05 When a statutory holiday occurs during an Employee’s vacation, the Employee shall be granted an extra day’s vacation if the holiday is one for which the Employee would have received pay had they been working.

c. All employees are required to bewagestake their vacation entitlement during the applicable vacation year. The vacation year shall begin June 1st continuing until May 31st of the following year. Employees who fail to submit their requests as required by Article 12.04 will be scheduled by the Employer in its discretion. Vacations shall be scheduled to start on a Monday and shall be in full weeks and not parts of a week.
a. For the purpose purposes of definitioncalculating vacation time entitlement, "the employee's seniority as of May 31st shall be used.
b. When an employee reaches the required seniority to advance to the next level of vacation pay, they will then begin to accrue at the higher percentage.
c. Vacation Pay" means four percent entitlement in a given vacation year is determined by the applicable entitlement related to the percentage of the employee’s wages on the last day (4%) or, after five (5) consecutive years of employment, six percent (6%May 31st) of the wages orprevious vacation year.
12.03 Employees shall be paid vacation pay under the following circumstances:
a. Employees shall be paid vacation pay during their scheduled vacation. This salary continuance shall be the default.
b. Any remaining vacation pay for the vacation year shall be paid out on the pay period ending closest to May 31.
12.04 On February 1st of each year the Employer shall post a blank vacation schedule sheet. Between February 1st and March 31st of each year, after ten (10) years of employment eight percent (8%) each employee shall have the right to indicate on this sheet the time during which she prefers to take her vacation.
12.05 The period at which employees shall take their vacations will be determined by the Employer who will take into account the staffing needs of the wages Home and order of an employee selections of available periods shall be by the employees according to seniority. Employees may not take more than two (2) weeks vacation during the Year months of Employment July and August. This restriction shall not apply in respectof which exceptional circumstances (such as a return to one’s homeland abroad or one’s marriage) if the employee is entitled to excused by her Administrator or her designate.
12.06 The Employer shall post the vacationfinal schedule on or about April 30th. 12.07 All normal deductions made from an employee's pay will be made from the vacation pay.
12.08 An employee who intends on resigning must, where possible, provide the Employer with two (2) weeks notice.
12.09 In order to accommodate staff during the holiday season, the parties agree that scheduling of vacation time off will be suspended between December 15th and January 15th. This restriction shall not apply in exceptional circumstances (such as a return to one’s homeland abroad or one’s marriage) if the employee is excused by mutual agreement betweenthe Company her Administrator or her designate.
12.10 During the period beginning with June 1st and ending one week after Labour Day, if more than one (1) full-time employee requests overlapping vacation leave, and the Employer determines that it will grant leave to more than one (1) full-time employee, unless then the following shall apply:
a. Vacation leave will be granted to the most senior applicant
b. Following (a), vacation will be granted to the next most senior applicant who regularly is scheduled to work a different shift of the day than the employee awarded vacation in (a).
12.11 Full-time employees with an emergency existsentitlement of three (3) weeks or more may use one (1) week of vacation as single days, to a maximum of five (5) days, according to their regular schedule. This time off may be used Monday through Friday, both inclusive. Requests for full weeks of vacation by other employees will take precedence over single day requests.

9.04 When vacations are requested by more employees than can be reasonably scheduled to be away at any one time and still carry on efficient company operations, after ten (10) years then the choice of employment eight percent (8%) of those employees permitted to take their vacation will be, insofar as possible, based on seniority.
a. The Employer shall include in each pay period the wages of an employee during the Year of Employment in respectof which the employee is entitled to the vacation. For the purpose of definitionwith regardto Vacations, "Year of Employment"means continuous employment of an employee by the Company for a year beginning May concluding April For the purpose of definition, "Vacation Entitlement" meansthe appropriate amount of vacation weeks pay in the gross pay for which all employees. The employee's cheques shall show the gross pay, and all regular deductions shall be made from the gross amount. An employee on vacation, should she so choose, shall not be prevented from making herself available to extra work opportunities.
16.03 The Company agreesmanner in which employees can take individual vacation days (ie. How many weeks in blocks must be taken before individual vacation days can be taken) shall be granted as per the Local Appendices. Otherwise, individual vacation days may be taken subject to the provisionsset forth within following:
a. The number of individual vacation days available to an employee shall be the regular number of shifts she works per week.
b. Individual vacation days may only be requested and granted outside of the vacation scheduling exercise described in the Local Appendices, that is, after the vacation scheduling contemplated there is complete.
c. Casual employees may not request individual vacation days.
d. Individual vacation day requests must be submitted before the work schedule in which that vacation day will fall is posted.
16.04 Employees may request to receive their vacation pay at the following sectionsto grant vacations with times throughout the year:
a. In the pay to employees covered by this Agreement. For period preceding, or the purpose of definition, "Vacation Pay" shall for all purposes be deemed to bewages. For pay period occurring during their vacation time;
b. At one other time during the purpose of definition, "Vacation Pay" means four percent (4%) or, after five (5) consecutive years of employment, six percent (6%) year at the request of the wages or, after ten (10) years of employment eight percent (8%) of employee;
16.05 At the wages of time that an employee during requests her vacation pay, she may identify the Year of Employment in respectof which amount she desires to receive, provided such amount does not exceed the employee is entitled to the vacation. For the purpose of definitionwith regardto Vacations, "Year of Employment"means continuous employment of an employee by the Company for a year beginning May concluding April For the purpose of definition, "Vacation Entitlement" meansthe amount of vacation weeks for which an employee is entitled based uponthe amount pay owing to her. Requests shall be submitted on a form to be provided by the Employer and must be submitted in advance of continuous employment completed from their own individual anniversary date within of Employment. the pay period ending to be received on the next date.

16.07 Vacation pay owed to casual employees shall be given in one consecutive period, except for the limitations under paragraph Page right to of The Company and the Union agree that stabilization of continuous productionis a goal to be attained. To this end, the Union recognizesthat the Company schedulevacationsand that it may be necessary to restrictthe number vacation at any one time. VACATIONS AND VACATION PAY. The Company agreesSECTION 16.1 A regular full-time employee, subject except police dispatchers, is entitled to time off with pay as Vacation, and shall receive Vacation Pay of eight (8) times his regular, straight-time hourly rate of pay for each day of Vacation.
SECTION 16.2 A regular full-time employee shall begin to accrue vacation upon the completion of one hundred twenty (120) calendar days of employment with the City at a rate of one (1) day of vacation per each sixty days of calendar service up to an employee's first anniversary date of employment or January 1, whichever shall occur first. Thereafter, vacation time shall accrue on a pro-rated monthly basis commencing on January of each year. Vacation time shall accrue based upon the number of years of uninterrupted service which an employee will achieve during the calendar year. After January 1 of each year, an employee may "borrow" against vacation time which will accrue during the year. However, should an employee leave the employ of the City at a time when "borrowed" vacation time has not yet been accrued, a deduction for vacation time taken but not accrued shall be made from the employee's final paycheck. Vacation time shall accrue pursuant to the provisionsset forth chart attached as Appendix B.
SECTION 16.3 Vacation requests must be approved by the employee's supervisor. Vacation days must be requested at least twenty-four (24) hours in advance, except in case of personal emergencies.
SECTION 16.4 While the City prefers that vacation days be taken within the following sectionsto grant vacations calendar year in which they accrue, employees can, at the end of each calendar year, bank one-half of the number of vacation days accrued in that year. All banked vacation days must be taken in the calendar year subsequent to the year in which they were earned. Should an employee fail to utilize banked vacation days, at the City's option either vacation time will be forfeited and vacation pay will be paid on the last day of the calendar year, or the City may require the employee to take vacation time during the last month of the calendar year.
SECTION 16.5 An employee who terminates his employment with pay to employees covered by this Agreementthe City shall be paid for Vacation earned but unused as of the date of termination on a pro rata basis. For the purpose of definition, "Vacation Pay" shall for all purposes be deemed to bewages. For Up to eighty (80) hours of compensatory time may be banked; once the purpose eighty (80) hour cap is reached, overtime work must be compensated by overtime pay. Employees with accrued compensatory time may request time off (in increments of definitionwith regardto Vacations(1) or more hours), "Year of Employment"means continuous employment which shall be requested with at least seventy-two hours advanced notice, except in the case of an extreme personal emergency. Requests to use accrued compensatory time may not be unreasonably denied, and may not create overtime in either the Street or Water Departments. Only one bargaining unit employee shall be on a compensatory day off or a paid day off (PDO) per day. Once the employee’s compensatory time bank has been drawn down by the Company for a use of compensatory time off, the employee may again elect to receive overtime in the form of compensatory time rather than overtime pay, up to the eighty (80) hour cap. Accrued compensatory time may be carried over from year beginning May concluding April For to year.
