VACATIONS AND VACATION PAY. 9.01 Employees who have completed less than five (5) years of continuous service with the Employer shall receive two (2) weeks of vacation with pay equal to four percent (4%) of their annual gross earnings. 9.02 Employees who have completed five (5) years of continuous service with the Employer shall receive three (3) weeks of vacation with pay equal to six percent (6%) of their annual gross earnings. 9.03 Employees who have completed ten (10) years of continuous service with the Employer shall receive four (4) weeks of vacation with pay equal to eight percent (8%) of their annual gross earnings. 9.04 Employees who have completed twenty (20) years of continuous service with the Employer shall receive five (5) weeks of vacation with pay equal to ten percent (10%) of their annual gross earnings. 9.05 Employees shall be entitled to have at least one (1) week of vacation during the summer vacation season. Employees entitled to more vacation will take the remainder of their vacation period prior to or after the summer vacation season. The Employer shall give all employees with more than three years of seniority who request it a second week during the summer vacation season subject to scheduling and business requirements. 9.06 The Employer agrees to allow up to two (2) drivers to be away on vacation at the same time during the summer season (May 15 through September 15) subject to scheduling and availability of replacement drivers. 9.07 Vacation time off will be granted in accordance with seniority and business requirements. To assist in vacation scheduling, the Employer will post a form on the bulletin board by January 1st and remove same on April 15th of each year. During this period each eligible employee must indicate the vacation period he wishes to take during the following calendar year. The Employer will post a finalized vacation schedule by April 30th, which shall not be changed without the consent of the Employer.

VACATIONS AND VACATION PAY. 10.01 All employees who are covered under this Agreement shall receive vacation pay, inclusive of public holiday pay, as a percent of the employee's total earnings exclusive of the Employer's contribution to the Union's Pension, Health Benefit Plan, Education and Assistance Fund and Industry Fund. Employees who are rehired following an absence due to involuntary temporary layoff, trade school, illness and/or injury shall be considered as employed for the purposes of this Article. 10.02 The parties confirm that such manner of paying public holiday pay meets the Employer’s obligations under the Employment Standards Act, 2000. 10.03 Vacation periods shall be arranged by mutual agreement between the Employer and each employee. Employees shall be granted their vacation periods as requested insofar as it is practicable and in accordance with seniority. 10.04 The Employer agrees to remit the Vacation Pay of each employee to the Union's Employee Trust Fund by no later than the fifteenth of the following month in which such vacation pay is earned. Vacation Pay shall be remitted together with, and in the same manner as union dues, as described at Article 7. 10.05 In accordance with the Employment Standards Act, the Union and its Vacation Pay Trust Fund, is obligated to take any steps which may be available to it either in law or in equity or in bankruptcy as may be necessary or desirable to effect collection from delinquent Employers. All costs incurred in the collection of said payment will be charged to such defaulting Employer.

VACATIONS AND VACATION PAY. Each employee shall be entitled to 120 hours of vacation annually with full pay. Upon the completion of two years of service in the aggregate, each employee shall be entitled to 128 hours vacation annually with full pay. Upon the completion of ten years of service in the aggregate, each employee shall be entitled to 192 hours vacation annually with full pay. Upon completion of 30 years of service in the aggregate, each employee shall be entitled to 200 hours vacation annually with full pay. On January 1 of each year, vacation time accrued during the previous year shall be credited to each employee.

A minimum of one thousand dollars ($1,000.00) of vacation pay will be held by the company and paid out to the employee at the time of the employees main scheduled vacation. 9.02 Employees, after completing ten (10) years of service, will be entitled to the following: 15 years - 4 weeks vacation with pay equal to eight percent (8%) of gross annual earnings. 9.03 The Employer will grant vacations at the times requested in the vacation seasons or period. The employees are entitled to take two (2) weeks of their annual vacation at their discretion; any additional time may have to be taken during the slack season. In order to prevent undue interference with the normal business requirements, it is understood and agreed that employees shall not take vacations simultaneously.

For tax purposes, vacation pay and statutory holiday pay shall be taxed over the period of time during which it was earned. 10.02 Approval of vacation time is at the sole discretion of the Employer. The vacation pay for all employees will be remitted monthly by the Employer to the Union’s Vacation Pay Trust Fund, together with an itemized list of the employees for whom remittances are made and the amount of vacation pay remitted for each. b. Remittances to the Vacation Pay Trust Fund shall be made promptly by the fifteenth (15th) of each month for the credited amounts in the previous month, in order to satisfy the legal requirements pertaining to the disbursement of vacation pay.
VACATIONS AND VACATION PAY. 25.01 Annual vacations with pay shall be based on total service with the Employer. For the purpose of calculating vacation entitlement, the vacation year commences May 1st and ends April 30th. (a) An Employee who has completed less than twelve (12) months of service as of May 1st shall be granted one (1) working day for each full month of service from the first of any month, up to a maximum of ten (10) working days. (b) A new Employee shall not take any vacation during his or her first six (6) months of employment. During the second six (6) months of employment, a new Employee shall be entitled to take vacation not to exceed five (5) working days which, if taken, shall be deducted from the Employee’s entitlement upon reaching the first anniversary date of his or her employment. Notwithstanding anything, these days may be taken one (1) or more at a time. The scheduling of such days of vacation shall be subject to mutual agreement between the Employee and the Employer. 25.03 An employee with one (1) or more years of service as of May 1st, shall be granted ten (10) working days vacation. 25.04 An employee with two (2) or more years of service as of May 1st, shall be granted fifteen (15) working days vacation. 25.05 An employee with eight (8) or more years of service as of May 1st, shall be granted twenty (20) working days vacation. 25.06 An employee with sixteen (16) or more years of service as of May 1st, shall be granted twenty-five (25) days vacation.

Vacation pay for such employees will be paid on the basis of four percent (4%) of gross earnings since their last computed vacation pay period.
