Common use of Vacation Carryover Clause in Contracts

Vacation Carryover. An employee shall be entitled to carry over a maximum of 70 hours of vacation in a year provided the bank of vacation carryover does not exceed 70 hours at any given time. Employees shall not receive cash in lieu of vacation time, except upon termination. The restrictions in this clause do not apply in situations where the Employer does not permit scheduling of the vacation prior to the end of the year. Any outstanding vacation owed to employees that have been in receipt of disability benefits for two consecutive years may be paid out at the employees request and at the rate of pay at the time of disability on the second year anniversary of the disability claim.
