Utilization of Vacation Credits. (a) Subject to the provisions of this Article, it is the intent of the Parties that no faculty member shall be restricted in the time of year chosen to take vacation entitlement. However, all faculty members shall be allowed to take at least five (5) weeks of their vacation entitlement during the period May 1 to September 30 inclusive, which shall be defined as the prime-time vacation period. (b) The full vacation entitlement would normally be scheduled to fit in with class schedules (low enrollment periods). (c) A teaching schedule will be developed in September in order that faculty members may identify periods wherein they may schedule annual vacation. Where vacation requests are for periods other than low enrollment, they will be considered on an individual basis, taking into account the reasons for the request, budget limitations and course cost implications. (d) A maximum of five (5) weeks of vacation in an unbroken period shall be granted on the basis of seniority within departments as first choice vacation period. Second periods of vacations shall be granted on seniority basis in a department but only after all "first" choices have been posted. The Employer shall make every reasonable effort to allow an eight (8)-week unbroken period if the faculty member desires. (e) Vacation schedules will be circulated and posted by April 1 of each year. (f) A faculty member who does not exercise seniority rights within two (2) weeks of receiving the vacation schedule shall not be entitled to exercise those rights in respect to any vacation time previously selected by a faculty member with less seniority. (g) Should programs not be offered in the following calendar year during the period July 1 to August 30, Union members affected will be advised in writing no later than June 1 of the preceding calendar year of this intention.
Utilization of Vacation Credits. All vacation earned during one (1) vacation year shall be taken during the next following vacation year, at a mutually agreeable time, except that an Employee may be permitted to carry-forward a portion of vacation entitlement to the next vacation year. Requests to carry- forward vacation shall be made in writing and shall be subject to the approval of the Employer. Such carry-forward shall not exceed thirty-eight point seven five (38.75) hours. Notwithstanding above 20.02, an Employee shall have the right to utilize vacation credits during the vacation year in which they are earned, provided the following conditions are met: (i) such utilization does not exceed the total credits earned by an Employee at the time of taking vacation; and (ii) such vacation is taken at a mutually agreeable time
