USERRA Rights. [No change]
USERRA Rights. Employees in service in the uniformed services of the United States, as defined by the provisions of the Uniform Services Em- ployment and Reemployment Rights Act (USERRA), Title 38, U.S. Code Chapter 43, shall be granted all rights and privileges provided by USERRA and/or other applicable state and federal laws. This shall include continuation of health coverage as provided by US- ERRA, and pension contributions for the employee’s period of ser- vice, as provided by ▇▇▇▇▇▇. Employees shall be subject to all obligations contained in USERRA which must be satisfied for the employees to be covered by the statute. The Employer, in its discretion, may make additional payments or award additional benefits to employees on leave for service in the uniformed services in excess of the requirements outlined in the USERRA.

(b) Subsequent changes in time and form of payment— (1) In general. A plan that permits under a subsequent elec- tion a delay in a payment or a change in the form of payment (a subsequent deferral election), including a subse- quent deferral election made by a serv- ice provider or a service recipient, sat- isfies the requirements of section 409A(a)(4)(C) only if the conditions of this paragraph (b) are met. For pur- poses of this paragraph (b), except as otherwise expressly provided in this section, a subsequent deferral election is not considered made until such elec- tion becomes irrevocable under the terms of the plan. Accordingly, a plan may provide that a subsequent deferral election may be changed at any time before the last permissible date for making such a subsequent deferral election. Where a plan permits a subse- quent deferral election, the require- ments of this paragraph are satisfied only if the following conditions are met: (i) The plan requires that such elec- tion not take effect until at least 12 months after the date on which the election is made. (ii) In the case of an election related to a payment not described in § 1.409A– 3(a)(2) (payment on account of dis- ability), § 1.409A–3(a)(3) (payment on ac- count of death), or § 1.409A–3(a)(6) (pay- ment on account of the occurrence of an unforeseeable emergency), the plan requires that the payment with respect to which such election is made be de- ferred for a period of not less than five years from the date such payment would otherwise have been paid (or in the case of a life annuity or install- ment payments treated as a single pay- ment, five years from the date the first amount was scheduled to be paid). (iii) The plan requires that any elec- tion related to a payment described in § 1.409A–3(a)(4) (payment at a specified time or pursuant to a fixed schedule) be made not less than 12 months before the date the payment is scheduled to be paid (or in the case of a life annuity or installment payments treated as a single payment, 12 months before the date the first amount was scheduled to be paid).
