Use Operation. 4.1 Lessee shall use the Premises only for office, research, development and for product assembly, storage and distribution, and for no other purpose without the prior written consent of Lessor. Lessee shall operate its business in the Premises during the entire Lease Term and in compliance with all applicable laws, ordinances, regulations, covenants, restrictions, and other matters shown on the public records, now in force and all applicable laws, ordinances and regulations hereafter enacted; provided, however, that Lessee shall not be required to comply with any amendments hereinafter made to the Protective Covenants (as hereinafter defined) or any other restrictive covenants existing as of the date hereof and encumbering the Premises if such amendments impose a greater restriction on the use or development of the Premises. Lessee will not permit, create, or maintain any disorderly conduct, trespass, noise, or nuisance whatsoever about the Premises which has a tendency to annoy or disturb any persons occupying adjacent premises. 4.2 Lessee shall cause all loading and unloading of any goods or materials delivered to or sent from the Premises to be done only at the loading dock area of the Building or such other dock area as Lessor may designate; provided that packages and other goods the delivery of which to other entrances will not harm or otherwise damage the paint, finish or any other aspect of the Building may be delivered to any door of the Building. Lessee hereby agrees to remove within five (5) days of receiving notice from Lessor any goods or materials delivered to or sent from the Premises stored on, accumulated on or obstructing the loading dock area, trash bay, sidewalks, driveways, parking areas, or entrances of the Building. 4.3 Lessee shall not perform or permit any work to be done on the loading dock (on the exterior of the Building), sidewalks, driveways, parking areas, or landscaped areas of the Premises without obtaining the prior written consent of Lessor, which shall not be unreasonably withheld. 4.4 Lessee shall not use, handle, store, deal in, discharge, or fabricate in violation of any local, state, or federal environmental protection legislation or regulation any environmentally hazardous wastes or materials as the same are now or hereafter may be defined or classified by any local, state, or federal environmental protection legislation or regulation issued pursuant thereto.
Use Operation. Lessee shall obey and comply with the laws, rules, and regulations of the United States, the several states, municipalities and any other governmental body having lawful jurisdiction over the Aircraft both with regard to the ownership, possession, and use of the Aircraft and to the maintenance of the Aircraft in an airworthy condition necessary for aircraft license and shall save Lessor harmless from actual or asserted violations. At all times during the Term and at Lessee's sole cost and expense, Lessee shall cause the Aircraft to be operated and managed by an aircraft management company acceptable to Lessor under a written contract which is acceptable to Lessor.
Use Operation of Hotels and Quiet Enjoyment -------------------------------------------- A. Tenant shall operate the Hotels as hotels and for no other use and under standards comparable to those prevailing for other Courtyard by Marriott hotels operated by Tenant or its Affiliates and for all activities in connection therewith that are customary and usual to such an operation; provided, however, that Tenant shall not be held to such standard if Landlord fails (i) to approve the Repairs and Equipment Estimate or provide funds necessary to pay for the repairs, replacements, and renewals covered therein in the event funds in the Reserve are inadequate, or (ii) to approve the Building Estimate or provide funds necessary to pay for the alterations, improvements, renewals and replacements covered therein, in either case if Landlord's failure to so approve or provide funds prevents Tenant from maintaining such standard. Tenant shall, except as otherwise provided in this Agreement, be responsible for the proper and efficient operation of the Hotels. B. Tenant shall have the option to terminate the Agreement with respect to a given Hotel at any time upon sixty (60) days' written notice to Landlord in the event of a withdrawal or revocation, by any lawful governing body having jurisdiction thereof, of any license or permit required for Tenant's performance hereunder as to such Hotel where such withdrawal or revocation is due to circumstances beyond Tenant's control. C. Except as otherwise provided herein, Tenant shall, during the Term, operate each of the Hotels continuously except to the extent and for such time as Tenant is unable to operate any of the Hotels according to the standards set forth herein as a result of (1) damage or destruction caused by fire, casualty, or other cause, (2) condemnation, (3) any of the occurrences described in Section 15.03, or (4) all or any portion of any Hotel being closed for alterations, improvements, renewals, rebuilding, or repairs. D. Tenant shall, upon the request of Landlord or Landlord's mortgagees, or the agent of either of them, make a qualified representative from Tenant's corporate staff available at reasonable times and intervals to answer questions regarding the operation of the Hotels. Use Operation a. Lessee shall maintain the exclusive possession, operation, and control of the Equipment. Lessee shall not: (i) sell, assign, transfer, pledge, hypothecate or otherwise dispose of the Equipment or any interest therein, (ii) rent, sublet or lend the Equipment to anyone, or (iii) permit the Equipment to be used by anyone other than its qualified employees.
Use Operation. Renter represents that they are capable of operating the rental equipment lawfully and safely, and therefore agrees to do so. Renter represents that the equipment is in good working order, condition and repair. Renter is responsible for noting any damage on the back of this form prior to taking possession of the equipment. Furthermore, renter shall advise if there are any safety issues regarding any of the equipment provided before utilizing. Renter agrees to obey ALL state and local laws ;(under which this agreement shall be governed and constructed by). PFD’s + Leashes are always required.

Safe Operations include the application and enforcement of rules, procedures and protocols that are intended to ensure the safety of personnel operating or performing work or tests on transmission facilities.
