Use of the Term. Agent". The term "Agent" is used herein in reference to the Agent merely as a matter of custom. It is intended to reflect only an administrative relationship between the Agent and the Banks, in each case as independent contracting parties. However, the obligations of the Agent shall be limited to those expressly set forth herein and in no event shall the use of such term create or imply any fiduciary relationship or any other obligation arising under the general law of agency.
Use of the Term. “Company”. The term Company as used herein shall mean Company, Parent and/or Holdings and any subsidiaries of Company, unless the context shall dictate otherwise, and the obligations of Company, Parent and Holdings hereunder shall be joint and several.
Use of the Term. INFOMART". Landlord reserves the right -------------------------- to approve Tenant's usage of the term "INFOMART", and Tenant shall not use the term "INFOMART" in any of its activities (including advertising and marketing activities) without the prior written consent of Landlord. Copies of all proposed written materials and advertising containing references to the term "INFOMART" shall be furnished to Landlord in advance for its review and approval. Any permitted use of the term "INFOMART" by Tenant shall additionally include the phrase "The Technology Community" immediately after such use. Tenant shall not permit any third party to use the term "INFOMART" in any of its activities and shall report to Landlord any unauthorized uses of such term as it comes to its attention. The breach by Tenant of any provision in this Section 6.8 shall constitute an event of default under this Lease and shall entitle Landlord to exercise any right or remedy available to Landlord under this Lease, at law, or in equity. Tenant shall indemnify and hold Landlord harmless from and against any loss, cost, claim, liability, cause of action, or expense whatsoever (including attorney's fees and other costs and expenses of defending any such claim) arising or alleged to arise from any unauthorized use by Tenant, or any Tenant Related Party, of the term "INFOMART".
Use of the Term. “additional amounts”. Whenever the Indenture refers to the term “additional amounts” in Sections 4.01, 5.01, 5.02, 9.02, 10.10 and 12.04 of the Indenture, such term shall be deemed to be “Additional Amounts” as defined in Section 5.1 above.
Use of the Term. “CITY” Reference to “CITY” in this Agreement includes CITY Manager, the designated CITY representative, or any authorized representative acting on behalf of CITY.
Use of the Term. “Lease Year”. Throughout the Demised Term, the use of the term “Year” or “Lease Year” in this Lease shall refer to a period commencing December 1 and terminating as of November 30 of the subsequent calendar year. For purposes of this Lease, the term “month” shall be determined in reference to Tenant’s fiscal year, as set forth on Schedule 4.02 attached hereto (the “Fiscal Year Schedule”), and shall not mean a calendar month.”
