Use by Others. Forest Service shall have the right to use any road constructed by Purchaser under this contract for any and all purposes in connection with the protection and administration of the National Forest. Other parties, in connection with the logging of tributary National Forest timber, may use roads constructed by Purchaser hereunder when Contracting Officer determines that such use will not materially interfere with Purchaser’s Operations. Third party use shall be contin- gent upon Contracting Officer determining, and third party agreeing to pay, a fair share of maintenance cost com- mensurate with such commercial use. Unless otherwise provided in C5.4, Forest Service shall authorize other uses of roads constructed by Pur- chaser hereunder only if:
Use by Others. The State reserves the right to issue timber permits or other permits on the sale area for forest products not included in this Contract or for other uses not in conflict with this Contract. The State also reserves the right to permit other persons to cross the sale area to gain access to other lands for fire suppression or for other purposes. Where the Purchaser improves or reconstructs an existing road, the use thereafter by the Purchaser shall accommodate safe use by others.
Use by Others. Except as described in “Contact in the Event of Loss, Theft or Unauthorized Use; Your Liability for Unauthorized Transactions” below, you are liable and responsible for all transactions, fees, and other activity with respect to the Card or Account. You may not permit another person to have access to your Card or Account. If you do provide access to your Card or Account to another person, you are liable for all transactions and fees incurred by such person. You must notify us in writing to revoke permission for any person you previously authorized to use or access your Card or Account.
Use by Others will ensure that only authorised persons use the Windcave Solution and that the Windcave Solution is used only for the Permitted Use and as expressly authorised under this Agreement;
Use by Others. The Customer acknowledges that Pracctice is unable to exercise control over the content of information passing over the Pracctice network or via the Service, and Pracctice hereby excludes all liability of any kind for the transmission or reception of infringing information of whatever nature.
Use by Others. Lessee agrees to allow other persons or organizations to use the premises, subject to the reasonable terms and conditions. City and Lessee agree that Xxxxxx will have the opportunity to review proposals for activities at the facility at least one year in advance, or before the schedule for the following season is complete. If other persons or organizations use the premises, Lessee may be compensated for use of the facility and/or offered the opportunity to work on the event and earn compensation for their program. Both parties agree that Lessee or its designee shall participate in the local organizing committee that is charged with reviewing and fully considering any proposals for use of the facilities by others.
Use by Others. An event occurring whilst the appliance is in the custody of a third party. In this exclusion, third party means anyone other than you or a member of your immediate family normally resident at the address shown in the Contract Schedule.
Use by Others will ensure that only authorised persons use Payment Express and that Payment Express is used only for the Permitted Use and as expressly authorised under this Agreement;
Use by Others. Lessee shall allow other persons or organizations to use the Premises if the Premises are not in bona fide use by the Lessee, and Lessee may require that such use by others shall be consistent with the normal usage of said Premises. This use is in addition to any assignment or sublease of the Premises, which is addressed in Section 13. In addition to the provisions in Section 6, Lessee agrees to allow other persons or organizations to use the Premises at the City’s direction, subject to reasonable terms and conditions, even if it interferes with Lessee’s use of the Premises as provided in Section 4. City and Lessee agree that Lessee will have the opportunity to review proposals for such use of the Premises at least six months in advance, or before the schedule for the season is complete, whichever is later. If other persons or organizations use the Premises, Lessee may be compensated for use of the Premises and/or offered the opportunity to work on the event and earn compensation for its program. Both parties agree that Lessee or its designee shall participate in the local organizing committee, if any, that is charged with reviewing and fully considering any proposals for use of the Premises by others.
Use by Others. 3(f). If during the course of performing the Work the Contractor transfers electronic files furnished pursuant to this Clause 3 to a third party, the Contractor agrees to obtain written confirmation that such third party agrees to the terms and conditions set forth in this Clause 3 prior to transfer thereof and as a condition of their use.
