Upon the Lease Commencement Date. Tenant shall pay to Landlord the Rent due and payable for the first full calendar month of the Lease Term. If the Lease Commencement Date is not on the first day of a calendar month, Tenant shall pay to Landlord the prorated Rent for the first partial month of the Lease Term.

Upon the Lease Commencement Date and after Landlord shall have received from Tenant (i) payment in full of the first month's Rent, (ii) an insurance certificate evidencing Tenant's liability insurance coverage as required under Paragraph 13, (iii) an acceptable corporate authority as xxxxxxxx xx Xxxxxxaph 38, (iv) a copy of the Occupancy Permit for the Premises and (v) a full, unconditional lien release for the complete construction of the Premises, Landlord shall pay a brokerage commission to Catalyst Real Estate Group in the amount of $100,000.00 respecting Tenant's leasing of the Premises under the terms of this Lease, pursuant to a separate written agreement between Landlord and Catalyst Real Estate Group. Nothing herein shall preclude Tenant from agreeing to pay any supplemental compensation to Catalyst Real Estate Group for its services rendered to or on behalf of Tenant. Except as provided above, each of Landlord and Tenant represents and warrants to the other that no party is entitled to any real estate brokerage or salesperson commission or any finders' fee as a result of such party's action in connection with the leasing of the Premises to Tenant. Each of Landlord and Tenant shall save, protect, defend, indemnify and hold the other harmless from and against any claim to the contrary by any salesperson, broker or finder based upon such salesperson's, broker's or finder's relationship with such party.

Upon the Lease Commencement Date. Tenant shall provide to Landlord a complete list of all chemicals, toxic waste or Hazardous Materials employed by Tenant within the Premises. Throughout the terms of the Lease, Tenant shall continue to update this list of chemicals, contaminants and Hazardous Materials. Landlord hereby represents to Tenant that Landlord is not aware (without a duty to inspect) of the presence of any Hazardous Materials that would affect Tenant's use and occupancy of the Premises. Notwithstanding anything herein to the contrary, Xxxxxxxx agrees to hold Tenant harmless from any cost or expense related to Hazardous Materials that were in existence at the Premises or Complex prior to the commencement of the Lease or which are not attributable to Tenant's activities or Tenant's use and occupancy of the Premises.

Upon the Lease Commencement Date. Tenant shall provide to Landlord a complete list of all chemicals, toxic waste or other materials constituting Hazardous Materials other than standard office and janitorial supplies employed by Tenant within the Premises. Throughout the terms of the Lease, Tenant shall continue to update this list of chemicals, contaminants and Hazardous Materials. Notwithstanding anything to the contrary in this Lease, in no case shall Tenant be responsible for Hazardous Materials or contamination there from in, on, or under the Premises or the Complex which precedes the Commencement Date unless it can be shown that Tenant is directly responsible for said contamination.

Related to Upon the Lease Commencement Date

Lease Commencement Date The earlier to occur of (i) the date upon which Tenant first commences to conduct business in the Premises, and (ii) sixty (60) days following the date of delivery of the Premises from Landlord to Tenant, which delivery date is anticipated to be May 1, 2002, as such date may be adjusted pursuant to the Tenant Work Letter attached hereto as Exhibit B.
Rent Commencement Date The "Rent Commencement Date" shall be the date that Tenant first uses the Premises or any portion thereof for any purpose permitted under this lease. In the event this lease pertains to a building or building interior finish to be constructed, the "Rent Commencement Date" shall be the date upon which the buildings and other improvements erected and to be erected upon the premises shall have been substantially completed in accordance with the plans and specifications described on Exhibit "C" attached hereto and incorporated herein by reference, provided however, that if Landlord shall be delayed in such substantial completion as a result of: (i) Tenant's failure to agree to plans, specifications, and cost estimates, within a reasonable period of time; (ii) Tenant's request for materials, finishes or installations other than Landlord's standard; (iii) Tenant's changes in plans: the commencement date and the payment of rent hereunder shall be accelerated by the number of days of such delay, and provided further that if Landlord cannot substantially complete the premises as a result of any events (i) through (iii) above, Landlord may as its election complete so much of Landlord's work as may be practical under the circumstances and, by written notice to Tenant, establish the commencement date as the date of such partial completion, subject to any applicable accelerations due to delays resulting from events (i) through (iii) above. Taking possession by Tenant shall be deemed conclusively to establish that said buildings and other improvements have been completed in accordance with the plans and specifications and that the premises are in good and satisfactory condition, as of when possession was so taken. Tenant acknowledges that no representations as to the repair of the premises have been made by Landlord, unless such are expressly set forth in the lease. After such "Rent Commencement Date" Tenant shall, upon demand, execute and deliver to Landlord a letter of acceptance of delivery of the premises. In the event of any dispute as to substantial completion of work performed, execute or required to be performed by Landlord, the certificate of Landlord's architect or general contractor shall be conclusive.
Commencement Date The Subcontractor shall be permitted to begin the Services on ______________________, 20____ (“Commencement Date”).
Service Commencement Date The date the Transmission Provider begins to provide service pursuant to the terms of an executed Service Agreement, or the date the Transmission Provider begins to provide service in accordance with Section 15.3 or Section 29.1 under the Tariff.
Term of the Lease The lease begins at p.m. on (the “Check-in Date”) and ends at a.m. on (the “Checkout Date”).
COMMENCEMENT/EXPIRATION DATE This instrument is executed as of the date of last signature and is effective for five years from that date, at which time it will expire unless extended.
Term Commencement Date The term of this Agreement shall commence on , 2020 (the “Commencement Date”) and, unless earlier terminated in accordance with the terms of this Agreement, shall end on June 30, 2055 (the “Term”).
Initial Lease Term The Initial Lease Term is for a minimum of ten (10) years; however, the State will consider a longer lease term if economic benefits are deemed to be in the State’s best interest. Please propose a fixed, or flat, rental rate for a Gross Lease: including all expenses – taxes, insurance, janitorial services, maintenance, etc. The State may elect to pay for utilities separately so please include a cost per square foot to reduce the rental rate if such occurs.
Base Term Commencing on the Expansion Premises Commencement Date, the defined term “Base Term” on page 1 of the Lease is deleted in its entirety and replaced with the following:
