Unscheduled Outages. 10.2.1 In case of an Unscheduled Outage due to failure of any part of the equipment forming part of the Facility Unit, the Seller shall inform the Buyer within four (4) hours from the commencement of the Unscheduled Outage of the time period that the Facility Unit is expected to be unavailable, if that time period extends or is expected to extend for the period from 00:00 to 24:00 of any given Day. Unscheduled Outages that are expected to extend for less than the twenty four (24) hour period from 00:00 to 24:00 of any given Day do not need to be reported to the Buyer in terms of this section.

Unscheduled Outages. Seller shall advise Buyer and System Operator of the need for any Unscheduled Outage, together with the proposed commencement date and estimated duration of the work to be undertaken. Buyer and System Operator shall advise Seller of the periods during which such Unscheduled Outage may be undertaken, such periods to be reasonable in light of Buyer’s requirements for Net Electrical Output and System Operator’s requirements for Ancillary Services and the necessity for the Unscheduled Outage.

Unscheduled Outages. Subject to the terms of this Agreement, Parties may, acting as a Reasonable and Prudent Operator, carry out maintenance or repair of their facilities at times other than during Scheduled Maintenance where such maintenance or repair cannot be deferred to the next Scheduled Maintenance or upon the occurrence of a Forced Outage. In such a case of unexpected outage or need of maintenance, the Party who is defaulting has to inform immediately to the other Party, to the System Market Operator and to his TSO of the characteristics of the outage and the time he estimates that will take to return to normal service.
