COLLECTIVE AGREEMENT WAGE RATES In recognition of the contract year moving forward five months, the Employer will provide a lump sum payment to all bargaining unit members on payroll the first Sunday after ratification (SAR) dependent on their average weekly hours (calculated from Jan 1, 2020 until June 1, 2020) in accordance with the following: • 32 Hours or more - $300 • 24-31 hours - $200 • 16-23 hours - $125 Only those active employees including those on paid leave, during the period of January 1, 2020 to June 1, 2020 period will be eligible for this lump sum payment All staff, including pharmacists, will receive a one-hundred ($100.00) SDM gift card in recognition of agreement on amendment to Wearing Apparel language under section 19(e) of the Agreement. Gift cards are to be provided to all employees by no later than SAR. Effective June 1, 2020, employees will be placed on the scale in accordance with their seniority hours. No employees shall see a wage reduction due to the implementation of the new scale. For year 1, employees who are over scale or who do not receive at least at $0.35 cent increase (from their pre June 1, 2020 rate), by virtue of the new scale, will be provided a $0.35 cent increase (from their pre June 1, 2020 rate), or otherwise be topped up to a $0.35 cent increase. For year 2, if an employee is at top of scale or over scale on June 1, 2021, they shall receive a $0.40 cent off scale increase. If they are not overscale, they will receive either the greater of $0.35, or the increase generated by their placement on the new scale. For year 3, if an employee is at top of scale or over scale on June 1, 2022, they shall receive a $0.45 cent off scale increase. If they are not overscale, they will receive the greater of either $0.35, or the increase generated by their placement on the new scale. All wage increases will be retroactive to June 1, 2020, for those who are still employed on SAR.

Employees on the new hire/post 1998 ratification wage grid shall remain on that wage grid until the ratio of hours between the senior employees and the new hire clerks exceeds fifty percent (50%) of the hours worked by the new hire clerks. For the purposes of determining the ratio, hours worked shall include all employees except Pharmacists and Front Store Managers. For the purposes of defining Senior Clerk wages and their incumbents, all hourly rates above twelve ($12.00) dollars per hour are defined as Senior Clerk wage rates. Employees on the new wage grid are eligible to move to the Senior Clerk’s wage grid based on the application of the above pararaph or by reason of having worked in excess of 5,200 experience hours. Such employees shall be reclassified and paid the appropriate starting rate under the Senior Clerk’s classificaton, and for the purposes of wage progression therafter, their hours shall be reset to zero (0) hours.   • Third Party Products and Services Through its Product(s), Palo Alto Networks may make available to you third-party products or services (“third-party apps”) which contain features designed to interoperate with our Products. All third-party apps are optional and if you choose to utilize such third-party apps:

  • Product ACCEPTANCE Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User(s) shall have thirty (30) days from the date of delivery to accept hardware products and sixty (60) days from the date of delivery to accept all other Product. Where the Contractor is responsible for installation, acceptance shall be from completion of installation. Failure to provide notice of acceptance or rejection or a deficiency statement to the Contractor by the end of the period provided for under this clause constitutes acceptance by the Authorized User(s) as of the expiration of that period. The License Term shall be extended by the time periods allowed for trial use, testing and acceptance unless the Commissioner or Authorized User agrees to accept the Product at completion of trial use. Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User shall have the option to run testing on the Product prior to acceptance, such tests and data sets to be specified by User. Where using its own data or tests, Authorized User must have the tests or representative set of data available upon delivery. This demonstration will take the form of a documented installation test, capable of observation by the Authorized User, and shall be made part of the Contractor’s standard documentation. The test data shall remain accessible to the Authorized User after completion of the test. In the event that the documented installation test cannot be completed successfully within the specified acceptance period, and the Contractor or Product is responsible for the delay, Authorized User shall have the option to cancel the order in whole or in part, or to extend the testing period for an additional thirty (30) day increment. Authorized User shall notify Contractor of acceptance upon successful completion of the documented installation test. Such cancellation shall not give rise to any cause of action against the Authorized User for damages, loss of profits, expenses, or other remuneration of any kind. If the Authorized User elects to provide a deficiency statement specifying how the Product fails to meet the specifications within the testing period, Contractor shall have thirty (30) days to correct the deficiency, and the Authorized User shall have an additional sixty (60) days to evaluate the Product as provided herein. If the Product does not meet the specifications at the end of the extended testing period, Authorized User, upon prior written notice to Contractor, may then reject the Product and return all defective Product to Contractor, and Contractor shall refund any monies paid by the Authorized User to Contractor therefor. Costs and liabilities associated with a failure of the Product to perform in accordance with the functionality tests or product specifications during the acceptance period shall be borne fully by Contractor to the extent that said costs or liabilities shall not have been caused by negligent or willful acts or omissions of the Authorized User’s agents or employees. Said costs shall be limited to the amounts set forth in the Limitation of Liability Clause for any liability for costs incurred at the direction or recommendation of Contractor.
