Union Rights. 5.1 5.01 The Union Board agrees that no Member shall notify be disciplined, demoted or discharged without just cause. Where the Board deems that a suspension is to be imposed, such suspension must be for a stated, definite reason(s).
5.02 The Board recognizes the right of OSSTF to represent a Member at any meeting when the conduct or competence of the Teacher is being considered.
5.02.1 A Member will be informed of the right to request representation prior to any meeting which involves or may lead to disciplinary action.
5.03 The Board recognizes that the Teachers in its employ have right of access to their personnel file in the Board=s Human Resources Department during regular working hours to examine the contents of their file in the presence of a Human Resources staff person.
5.03.1 A Member will be provided a copy of any written appraisal put in the Teacher=s file and will be allowed to add comments prior to filing.
5.03.2 If there is a dispute as to the accuracy of any material on file, said dispute may be the subject of a grievance.
5.03.3 Documents contained in writing, a Member=s file that are of a disciplinary nature will be destroyed by shredding after twenty four (24) months provided that there has been no subsequent disciplinary action of the following:same kind.
(a) Names of its representatives in 5.04 The Board shall provide a bulletin board for the Bargaining Unit on the Executive, Collective Bargaining Committee and Grievance Officer
(b) Address and phone number of its Head Office
(c) Address and phone number use of the Bargaining Unit Office
5.2 The Board at an appropriate location in each work site upon which the Bargaining Unit shall advise have the President right to post notices relating to matters of interest to the Bargaining Unit, in writing, of each new Member’s name and work location within thirty (30) working days of commencement of employment of the new MemberMembers and/or Occasional Teachers.
5.3 5.05 The Board shall notify the President of the Bargaining Unit, make every effort to provide a confidential meeting area in writing within five (5) working days, when a Member covered by this Agreement is promoted, demoted, transferred, will be laid off, is recalled, is disciplined, is put on review, or whose employment is terminated each work location for any reasonUnion business.
5.4 5.06 The Board shall advise all agrees to acquaint new Members with the fact that a Collective Agreement is in effect and provide the new Member with the name and business phone number so that these Members can be advised of the terms and conditions set out in the Agreement.
5.07 Any information regarding the status of a Member which can be made available, any information which is public information because it has been part of a Board report in public session, and any information regarding teacher salaries and insured benefits will be provided to the Bargaining Unit upon written request.
5.08 The Board shall assign or reassign duties to Members elected or appointed as Bargaining Unit delegates or representatives to permit attendance at a Bargaining Unit meeting. The Bargaining Unit shall reimburse the Board for the cost of a supply teacher, if a supply teacher is required and assigned.
5.09 Acceptance of Position blank forms, used for all Members who are subject to this Agreement, shall be accessible to the President of District 10, OSSTF.
5.10 The Board and the Union agree that there shall be no discrimination, interference, restraint or coercion exercised or practised upon any Member because of Union membership.
5.11 The Union shall be allowed to carry out Union business on the Board's premises including, without restricting the generality of the foregoing, Membership meetings, executive meetings, and conferences between Union representatives and Members at times other than the Members= scheduled instructional time.
5.12 The Board shall not discipline in any way a Member for reporting an incidence of misfeasance, malfeasance, fraud or any other action/inaction on the part of the Board which is believed to be detrimental to the students and/or the employees.
5.13 The Board shall provide a copy of each Member=s updated profile sheet on or about October 31, for the information of the Bargaining Unit.
5.5 The Union agrees not . Newly hired Members= profile sheets will be forwarded to engage in Union activities during normal working hours, except for normal break periods. The Union further agrees not to hold Union meetings on the premises of the Board without prior permission of the Manager, Employee Relations or designate unless otherwise provided in this Agreement.
5.6 The Union may use the inter-office mail service and electronic mail for the purpose of communicating with its Members. If the Board believes the use of the services is being misused, the Manager, Employee Relations shall so notify the President of the Bargaining Unit within thirty (30) calendar days.
5.14 The Board shall forward to the District President no later than ten (10) working days after the start of school each semester the following information by school: a staff list showing names, addresses, and phone numbers of all Members; all teachers= timetables; all class sizes; each school=s pupil/teacher ratio; each school=s average class size; a copy of the matter may be taken up as a school=s duty schedule including minutes scheduled; and any other information determined by the Secondary Staffing Committee.
5.15 The Board Grievancewill inform the Union of any changes made to its policies and regulations or the introduction of new policies and regulations.

Union Rights. 5.1 5.01 The Board shall provide a suitable place in each work location for the posting of Union materials as approved by the Board.
5.02 The Employer agrees to acquaint new employees with the fact that a Collective Agreement is in effect, provide them with a copy of the agreement, and provide the new employee with the name, work location and phone number of the bargaining unit president.

5.4 5.05 The Board employer shall advise all new Members that a Collective Agreement is in effect and provide the new Member Bargaining Unit President with the name following information regarding members of the bargaining unit: • a list of employees, showing their name, work location, home address and telephone number.
5.06 The Union shall be allowed to carry out union business phone number on the Employer’s premises at reasonable times and in reasonable locations including, without restricting the generality of the foregoing, membership meetings, executive meetings, and meetings between representatives and members in accordance with Board Policy on Community Use of Schools.
5.07 All correspondence between the parties, arising out of the collective agreement or incidental thereto, shall pass to and from the Executive Manager of Human Resources of the Board, or the Manager of Human Resources and the President of the Bargaining Unit. Only correspondence between the parties, including copies, will be treated as formal correspondence which may have an effect on the interpretation or administration of the collective agreement.
5.5 5.08 The Union agrees Board shall not bargain with or enter into any agreement with an employee or group of employees in the bargaining unit, and an employee or group of employees in the bargaining unit shall not bargain with or enter into any agreement with the Board. No employee or group of employees shall undertake to engage in Union activities during normal working hours, except for normal break periods. The Employer agrees to facilitate the Union an opportunity to meet with each new Employee within regular business hours (8:00 am to 18:10 pm), without loss of pay, within the first 2 weeks of employment, to acquaint the new Member Employee with the name benefits and business phone number duties of Union membership and the President of Employee's obligations and responsibilities to the Bargaining UnitEmployer and the Union.
5.5 4.3. The Union Employer agrees not that there shall be no discrimination, interference, restriction, or coercion exercised or practised with respect to engage any Employee for reason of membership or activity in Union activities during normal working hours, except for normal break periodsthe Union.
4.4. The Employer recognizes the Union’s right to select stewards to represent Employees. There will be a maximum of two (2) stewards. The Union further agrees not to hold Union meetings on shall notify the premises Employer in writing of the Board names of all stewards.
4.5. Time without prior permission loss of pay shall be granted to the Union representative(s) when meeting with the Employer or his representative on matters concerning the application or administration of this agreement. The parties will ensure that the regular operation of the Manager, Employee Relations or designate unless otherwise provided in this Agreementschool will not be affected.
5.6 4.6. Time off without pay shall be granted by the Employer to four (4) Employees and/or Union representative(s) to attend meetings, conventions, workshops, or other matters pertaining to labour matters directly affecting the Union, provided that seven (7) days written notice is given of the date and duration of such time off. The Employer will not unreasonably deny leave requests for more than a limit of four (4) outlined above. The Employer will not deduct pay under this provision from the Employee and the Union may use the inter-office mail service and electronic mail will be billed for the Employee’s time at the Employee’s basic daily rate of pay.
4.7. The Employer agrees to provide adequate space in a permanent location for a bulletin board at the school campus(es) for the sole purpose of communicating with its Membersposting notices and letters pertaining to Union business.
4.8. If Subject to operational requirements, the Board believes the ETEA Local 7 may request use of the services is being misusedfacilities at the school campus(es) for meetings with the school Employees during normal business hours, the Manageri.e., Employee Relations 8:00 am to 18:10 pm from Monday to Friday (and after such hours by mutual agreement), excluding holidays. Permission shall so notify the President of the Bargaining Unit and the matter may not be taken up as a Board Grievanceunreasonably denied.

Union Rights. 5.1 5.01 The Union shall notify the Board, in writing, of the following:

5.4 5.05 The Board shall advise all new Members that a Collective Agreement is in effect and provide the new Member Employee with the name and business phone number of the President of the Bargaining Unit.
5.5 5.06 The Union agrees not shall be provided with access to engage in Union activities during normal working hours, except bulletin board space for normal break periods. The Union further agrees not to hold Union meetings on the premises posting of PSSP notices at the Board without prior permission of the Manager, Employee Relations or designate unless otherwise provided in this AgreementEducation Centre.
5.6 5.07 The Union may use the inter-office mail service and electronic mail for the purpose of communicating with its Members. If the Board believes the use of the services is being misused, the Manager, Employee Labour Relations or designate shall so notify the President of the Bargaining Unit and the matter may be taken up as a Board Grievance.
(a) Any official correspondence from the Board to the Union or the Bargaining Unit shall be sent to the President of the Bargaining Unit at the address of the office of the Bargaining Unit provided in clause 5.01 unless otherwise stated in this Agreement.
(b) Any official correspondence from the Union or the Bargaining Unit shall be sent to the Manager, Labour Relations at the main office of the Board unless otherwise stated in this Agreement.
5.09 The Board shall provide the Union with the names of the successful candidate for the posted vacancies.

Union Rights. 5.1 Section 1. The Union shall notify have access to space on campus, when available, for the Boardpurpose of conducting Union meetings, in writing, subject to College procedures regarding reservation and use of space and the needs of the following:College, provided there is no actual or attempted disruption of normal business and classroom activities. 5.3 Section 4. The Board Union shall have the right to post Union materials on the intranet as an MCAD Resource. Documents shall be furnished by and at the sole expense of the Union, and will be uploaded only by a Union ▇▇▇▇▇▇▇. A link to the SEIU website may be included. As with all resource pages on the MCAD intranet site, updates are the responsibility of the sponsor of the resource page. Materials posted on the site will be appropriate to the workplace, politically non- partisan, and in compliance with state law. The Union shall indemnify, defend, and hold the College, its agents, and employees harmless against any claim, demand, suit, or form of liability arising as a result of the posting of any Union materials on the College intranet. Materials that are not posted in accordance with the provisions of the Article may be removed by College representatives.
Section 5. The Union shall have the right to use the Faculty mail boxes and MCAD e-mail to notify Bargaining Unit members about Union activities, provided there is no actual or attempted disruption of business and classroom activities.
Section 6. Any search committee established for the hiring of a President of shall include one (1) Faculty Member from the Bargaining Unit, in writing within five (5) working days, when a Member covered by this Agreement is promoted, demoted, transferred, who will be laid off, is recalled, is disciplined, is put on review, or whose employment is terminated for any reason.
5.4 The Board shall advise all new Members that a Collective Agreement is in effect and provide the new Member with the name and business phone number of the President of the Bargaining Unit.
5.5 The Union agrees not to engage in Union activities during normal working hours, except for normal break periods. Union Rights. 5.1 (a) The Company agrees to recognize a maximum of eleven (11) stewards, one of whom will be designated Chief ▇▇▇▇▇▇▇, elected or appointed by the Union from among the employees. The distribution of stewards will be set at a maximum of two (2) per shift (A, B, C, D, and day shift). In the event that more than one (1) ▇▇▇▇▇▇▇ is elected from the same shift and department, it is agreed by the Union that, in order to protect job responsibilities, no more than one (1) ▇▇▇▇▇▇▇ will be involved in union matters at the same time, except where otherwise authorized by management.
(b) In order to maintain sound labour relations, the Company will assign the Chief ▇▇▇▇▇▇▇ to a day shift position if so requested by the Union. The Chief ▇▇▇▇▇▇▇ will receive his regular hourly base rate for the position held by the Chief ▇▇▇▇▇▇▇ immediately prior to being transferred to the day shift position, whichever is greater. Upon completion, or termination of the tenure, the employee will be returned to his former position.
4.02 The Chief ▇▇▇▇▇▇▇, Stewards and/or a Union Agent of Local 213 may enter the Plant to administer the Collective Agreement with permission of Management. Should a Union official, other than those previously mentioned in this clause, request to enter the plant or premises, the Chief ▇▇▇▇▇▇▇ or Assistant Chief ▇▇▇▇▇▇▇ and Management will be advised.
4.03 The Union shall notify the Board, Company in writing, writing of the following:Stewards and Local Officers and effective dates of their appointments. This time is not to be used for discussion of labor/management disputes. The Agency shall provide the Union at least ten (10) days notice of the time and place of new employee orientation meetings. If the presenter is an Agency employee he/she will be allowed one (1) hour of Agency time including travel for this presentation.
a. The Agency will continue to provide reasonable bulletin board space for the use of the Union in communications dealing with social functions, meetings, elections, Union appointments and other Union-related information.
b. Union officers and stewards may post messages concerning internal union business to an electronic bulletin board established for this purpose, provided the Union meets all of the following conditions:
(1) The Union does not use the electronic bulletin board for interactive communications (messages may be taken up accessed, but no replies made);
(2) Employees may access and Union officers and stewards may post and access messages only during their authorized breaks and lunch periods;
(3) Employees will comply with the Agency’s applicable user policies, such as protection of confidential information and security of equipment; and
(4) The Agency will incur no additional costs resulting from the Union’s electronic bulletin board use. It is understood that the electronic bulletin board is not private, privileged or confidential. This provision will no longer apply if the Agency loses the ability to maintain an electronic bulletin board or if the Union’s electronic bulletin board use adversely affects the Agency’s computer system.
Section 3.8 Upon request and no more than once a month the Agency shall furnish to the Union an alphabetized listing of the names, classifications, and home addresses of the employees in the bargaining unit as well as a Board Grievancelisting of those employees who have terminated since the previous list.
Section 3.9 The Union shall be provided payroll deductions for its regular monthly dues in accordance with and as entitled to under ORS 292.055.

Union Rights. 5.1 5.01 The Union Board agrees that no Member shall notify be disciplined, demoted or discharged without just cause. Where the Board deems that a suspension is to be imposed, such suspension must be for a stated definite reason(s).
5.02 The Board recognizes the right of OSSTF to represent a Member at any meeting when the conduct or competence of the Teacher is being considered.
5.02.1 A Member will be informed of the right to request representation prior to any meeting which involves or may lead to disciplinary action.
5.03 The Board recognizes that the Teachers in its employ have right of access to their personnel file in the Board’s Human Resources Department during regular working hours to examine the contents of their file in the presence of a Human Resources staff person.
5.03.1 A Member will be provided a copy of any written appraisal put in the Teacher’s file and will be allowed to add comments prior to filing.
5.03.2 If there is a dispute as to the accuracy of any material on file, said dispute may be the subject of a grievance.
5.03.3 Documents contained in writing, a Member’s file that are of a disciplinary nature will be destroyed by shredding after three (3) years provided that there has been no subsequent disciplinary action of the following:same kind.
(a) Names of its representatives in 5.04 The Board shall provide a bulletin board for the Bargaining Unit on the Executive, Collective Bargaining Committee and Grievance Officer

5.3 5.05 The Board shall notify the President of the Bargaining Unit, in writing within five (5) working days, when a Member covered by this Agreement is promoted, demoted, transferred, will be laid off, is recalled, is disciplined, is put on review, or whose employment is terminated for any reason.

5.08 The Board shall assign or reassign duties to Members elected or appointed as Bargaining Unit delegates or representatives to permit attendance at a Bargaining Unit meeting. The Bargaining Unit shall reimburse the Board for the cost of a supply teacher, if a supply teacher is required and assigned.
5.09 Teacher Application and Acceptance of Position blank forms used for all Members who are subject to this Agreement shall be accessible to the President of District 10, OSSTF.
5.10 The Board and the Union agree that there shall be no discrimination, interference, restraint or coercion exercised or practised upon any Member because of Union membership.
5.11 The Union shall be allowed to carry out Union business on the Board's premises including, without restricting the generality of the foregoing, Membership meetings, executive meetings, and conferences between Union representatives and Members at times other than the Member’s/Members’ scheduled instructional time.
5.12 The Board shall not discipline in any way a Member for reporting an incidence of misfeasance, malfeasance, fraud or any other action/inaction on the part of the Board which is believed to be detrimental to the students and/or the employees.
5.13 The Board shall provide a copy of each Member’s corrected profile sheet on or about October 31, for the information of the Bargaining Unit.
5.5 The Union agrees not . Newly hired Members’ profile sheets will be forwarded to engage in Union activities during normal working hours, except for normal break periods. 7.03 It shall be the responsibility of each employee to notify HR Connect of any change in their address, telephone number, marital status, or number of dependents; failure to provide such information shall conclusively relieve the Company of any responsibility for failure by the Company to comply with any part of this Agreement where such information is required for such compliance. For the purpose of giving written notice may be hand delivered to the address of the employee contained in the records of the Company, or sent by mail. In the case of hand delivery such notice shall be deemed to be received by the day of delivery, and when mailed, shall be deemed to be received two calendar days following mailing.
7.04 The Union shall be permitted to post on the Company notice board, or notice boards, Union notices relating to the business of the Union or to the employment of the employees, provided however that only such notices as are first authorized by the Company shall be so posted.
7.05 Except as specifically provided in this Agreement, Union duties and activities shall not be carried out during hours of employment.
(a) Names If an employee with seniority is elected to be a delegate of its representatives the Union to a Union convention or labour school, and attendance at such convention or school requires leave of absence, such employee may be granted reasonable leave of absence without pay for a maximum period of eight (8) calendar days in the Bargaining Unit on case of a convention, and five (5) calendar days in the Executivecase of a school, Collective Bargaining Committee provided that application for such leave of absence shall be made in writing at least two (2) months in the case of a convention and Grievance Officerone (1) month in the case of a school in advance of the commencement of such requested period of leave of absence, and provided further that such leave of absence can be given without substantial interference with the work of the Company;

Union Rights. 5.1 5.01 The Board shall provide the Union with all necessary information relating to the Members within the bargaining unit in September of each year. 5.4 (b) The Board agrees to notify the union, in writing, within ten (10) working days, when a replacement or temporary Member is disciplined in writing, is suspended, and/or removed from the supply list.
5.04 The Board shall advise all new Members that a Collective Agreement is in effect effect.
5.05 The Board shall ensure that any Member new to a position or a worksite shall receive adequate orientation and provide training to perform the new Member duties of the position safely.
5.06 The Union may use bulletin boards for the use of the Union at appropriate locations, as determined in consultation with the name site supervisor, upon which the Union shall have the right to post notices relating to matters of interest to the Union and business phone number of the President of the Bargaining UnitMembers.
5.5 The Union agrees not to engage in Union activities during normal working hours, except for normal break periods. Union Rights. 5.1 6-1 The Union president of the union or designee or any of five (5) area representatives (two (2) of whom may be floaters) on their own time, may be allowed to visit buildings where union employees are working. Such visitations shall notify not interrupt the Boardemployees’ scheduled working hours (excluding lunch and breaks). Building stewards are available to assist in their or other buildings.
6-2 If negotiations, grievances, or other District mandated meetings are scheduled during the school day, those required to attend shall be released from their regular duties without loss of pay. No negative or disciplinary documentation will be placed in the personnel file arising from a union member’s participation in negotiations or grievances.
6-3 Up to fifteen (15) work days per year with pay and fifteen (15) days without pay will be granted to CWA for the purpose of conducting union business. In special circumstances, the Executive Director of Facility Management or designee will consider requests for additional unpaid days off. Said time may be taken in increments of two (2) hours, a half-day (½), or a full day. Said days must be approved by the Executive Director of Facility Management or designee, in writing, in advance. Union Rights. 5.1 5.2.1 The parties agree that the Union shall be entitled to all of the rights and privileges delineated in this Agreement. There shall be no rights implied beyond the specific terms of this Agreement.
5.2.1.1 Union officials and/or representatives not employed by the College shall have reasonable access to the College's premises for the purpose of conferring with the College's representatives and for the administration of this Agreement, provided that prior arrangement is made through the College's Human Resources Office.
5.2.1.2 Neither the Union nor the Local Union, nor any employee shall conduct Union business on the College’s premises except:
5.2.1.2.1 Solicitation of Union membership during lunch and break periods will be allowed.
5.2.1.2.2 Upon approval, Union representatives may confer with the College regarding the administration of this Agreement.
5.2.1.2.3 Notices, papers, leaflets, handbills and/or literature that have been approved by the College's Marketing and Communication Office may be posted on employee bulletin boards so long as nothing political, inflammatory, derogatory or disruptive to good labor/management relations is contained in the materials that are posted The parties agree that only mailings posted through the United States Postal Service may be sent through the College’s mail service. Employees disseminating information in accordance with this provision shall do so only on non-CNM paid time.
5.2.1.2.4 The Union shall notify have the Boardright to use the electronic mail systems or other similar communication systems of CNM to communicate with the bargaining unit regarding collective bargaining and the administration of the agreement, investigation of grievances or other disputes, and matters involving the governance or business of the Union. Nothing inflammatory, derogatory, or disruptive to good labor-management relations shall be contained in the email or written documents to be distributed and/or posted or communications with any College student media. Such information will be distributed and/or posted by Union representatives. For email communications to the entire bargaining unit utilizing the CNM email system the Union agrees to provide a copy in advance. The College shall not unreasonably delay or unreasonably deny the Union’s request. Email communication between a Union representative and an individual or individuals in the bargaining unit shall not be subject to approval. College resources shall not be used for any union activity including but not limited to political issues or a campaign for an individual candidate or an organization unless specifically authorized elsewhere in this Agreement unless the parties agree to an exception. In the event the College believes a violation of this Article has occurred it shall be brought to the attention of the Union President and the distribution in question shall be halted.
5.2.1.2.5 CNM shall permit the Union to use facilities for the purpose of conducting meetings with the bargaining unit without undue interference and as long as such meetings do not interfere with the operations of the employer.
5.2.1.3 The Local Union will furnish the CNM Labor Relations Officer, in writing, the names and respective authorities of Local Union representatives who have been designated to perform duties of the following:

Union Rights. 5.1 The Union being the exclusive representative for the purpose of meeting and negotiating shall notify fairly represent each and every employee in the BoardClassified Bargaining Unit. The District shall furnish the Union, upon request, information which is necessary, appropriate, and relevant for the Union to fulfill its responsibilities in writingconnection with negotiations, grievance processing, and maintenance of the following:

5.2 The Board Union President. On those days that the Union President is on vacation, sick leave, jury duty, bereavement or conference leave, the USW Local 8599 shall be granted up to thirty-five (35) additional days of leave to maintain coverage for the Union President, as necessary. Presidential Coverage is defined narrowly as those times when the Classified Bargaining Unit Member has to step into the President’s role to make decisions or act as the President, in writingrelation to those items of business which pertain to the role of President of USW, of each new Member’s name and work location within thirty (30) working days of commencement of employment Local 8599. Examples include signing documents on behalf of the new Member.
5.3 The Board shall notify Union in the place of the President, representations at certain meetings where the presence of either the President or Acting President of the Bargaining Unit, in writing within five (5) working days, when a Member covered by this Agreement Local is promoted, demoted, transferred, will be laid off, is recalled, is disciplined, is put on reviewrequired, or whose employment specific instances where the President requests that the Classified Bargaining Unit Member step in his/her place to represent the Local as an Acting President. Normal union business the Classified Bargaining Unit Member needs to conduct on behalf of the President, but which are not limited to presidentially exclusive roles such as employee discipline meetings, grievance meetings, Reduction in Force meetings or Union release for other Union business such as conference or Union membership meetings shall not count as Presidential Coverage, but rather debited from those appropriate leave sections, unless the meeting is terminated for any reason.
5.4 The Board shall advise all new Members of such nature that a Collective Agreement it is in effect and provide strictly within the new Member with the name and business phone number exclusive purview of the President of the Local. If the Union determines that it needs a Classified Bargaining Unit.
5.5 Unit Member to be released from work to be available at the Union Hall to stand in for the President in his/her absence, then that will be deemed to be Presidential Coverage even if there are no specific duties delineated as such. The Union agrees not above is an illustrative list and by no means exhaustive nor comprehensive as to engage in Union activities during normal working hours, except for normal break periodsthe situations which may come up. The Union further agrees and District agree to act in good faith in interpreting what constitutes Presidential Coverage. Presidential Coverage must be requested in writing to the Superintendent or designee at least three (3) working days in advance, if possible. The Superintendent or designee shall not to hold unreasonably deny such requests. The Union meetings on shall reimburse the premises District at the District-incurred substitute employee cost or at the Classified Bargaining Unit Member’s daily rate of pay when no substitute is used for each day of leave requested. Any one individual Classified Bargaining Unit Member may use no more than ten (10) of the Board without prior permission of the Manager, Employee Relations or designate unless otherwise provided in this Agreement.
5.6 Presidential Coverage days during a school year. The Union may use shall be provided with an additional seventy (70) paid working days of release time each fiscal year to be utilized when conducting Union business with each representative using no more than twenty (20) working days of said paid Union leave within each fiscal year. For the interpurpose of determining the representative’s maximum of twenty (20) working days of union release, a day is defined as the number of hours worked in the representative’s contract position. The Union shall reimburse the District at the District-office mail service incurred substitute employee cost for the first thirty-five (35) days, and electronic mail the remaining thirty-five (35) days at the Classified Bargaining Unit Member's daily rate of pay, or possible overtime expenses, for each day of Union leave expended and not reimbursed by the California State Board of Control. Upon written request to the Superintendent or designee, the Union shall receive an additional fifty (50) days of release time for the fiscal year for conducting Union business. The Union shall reimburse the District at the Classified Bargaining Unit Member’s daily rate of pay, or possible overtime expenses, for each day expended under this paragraph. The Union recognizes the obligation to keep appropriate records for the purpose of communicating with its Members. If establishing the Board believes the use necessary documentation for reimbursement of the services is being misused, costs involved in this provision which are obtainable through application to the Manager, Employee Relations shall so notify State Board of Control by the President of the District. Every effort will be made to inform Classified Bargaining Unit Members to direct communications to Union headquarters and not at the matter Union representative's work site or location. Exceptions to this provision may be taken up as a Board Grievanceconsidered appropriate when issues of employee health and safety or matters of urgency are involved.

5.4 The Board employer shall, upon notification, grant the Union up to a maximum of ten (10) days per year as time off for Union members to conduct Union business or participate in Union activities such as conventions and/or conferences. An employee with administrative approval may exchange shifts with another employee if such exchange can be arranged in order not to lose time or pay. If not, such time off shall advise all new Members that a Collective Agreement is in effect and provide the new Member be without pay. No more than three (3) employees shall be absent for union business on any given day. Additional days without pay as provided for above may be granted and/or additional employees may be excused with the name and business phone number approval of the President of the Bargaining UnitSuperintendent.

5.8 Employees may be evaluated at least once every three (3) years by the Administration. Additional evaluations may be done at the discretion of the administration. Evaluations shall be based on the direct observation and/or knowledge of the evaluator. Upon completion of the evaluation, the Manageradministration shall meet and discuss the evaluation with the employee. The employee shall be required to sign the evaluation. However, Employee Relations said signature shall so notify not be interpreted to mean agreement with the President content of the evaluation. The employee shall have the right to attach a response to the evaluation.
5.9 Bargaining Unit and unit members who are required to meet with the matter may Administration on Association business shall not be taken up as required to punch out to attend said meetings. Members of the Association Negotiations Committee shall not be required to punch out in order to participate in negotiations should a Board Grievancenegotiations session be scheduled during their work time.

Union Rights. 5.1 (a) The Union shall notify have the Boardright to use institutional equipment and facilities and buildings at reasonable times and at reasonable costs, in writingthrough regular district procedures. The OCSD Board of Education offices, of the following:
(a) Names of its representatives in the Bargaining Unit on the Executiveother administrative offices, Collective Bargaining Committee and Grievance Officerequipment, which may contain confidential information, are excluded from this article.
(b) Address The Union President shall upon request be provided copies of any budget, publicly disclosed materials, and phone number Board meeting agendas. The Union President shall be notified in advance of its Head Officeall OCSD Board of Education meetings.
(c) Address The Union shall be given use of mailboxes and the school mail system for transmission of official Union matters, and a bulletin board in each building for the posting of Union information.
(d) The local Union president, or his/her designee, and one other Union member chosen as a delegate shall be granted up to three (3) workdays of professional leave to attend OAPSE’s annual conference. This leave shall be at no expense to the OCSD Board of Education or designee except that the employee shall receive no loss of pay and the OCSD Board of Education will provide the substitute should the OCSD Board of Education deem a substitute necessary. Persons selected to attend the annual conference shall apply for professional leave using the district’s professional leave procedures.
(e) All employees shall be able to attend evening union meetings. Evening employees will be allowed to make up missed work time by extending their work time during the week of the meeting, and in consultation with the head custodian and principal.
(f) A list of names, addresses, and phone number numbers of newly hired classified staff shall be provided to the OAPSE president upon request.
(g) Up to two representatives of the Bargaining Unit Office
5.2 The Board shall advise the President and up to two representatives of the Bargaining Unit, union shall meet as needed for a labor-management meeting during normal working hours. The meeting may be waived by mutual agreement.
(h) The OAPSE President /designee has the right to meet with any newly hired employee (hired after the in-service day referenced in writing, paragraph i below) outside of each new Member’s name and the work location within day for a period of up to thirty (30) working days of commencement of employment of the new Member.

The Union further agrees not to hold Union meetings on the premises of the Board without prior permission of the Manager, Employee Relations or designate unless otherwise provided in this Agreement.
5.6 The Union may use the inter-office mail service and electronic mail for the purpose of communicating with its Members. If the Board believes the use of the services is being misused, the Manager, Employee Relations shall so notify the President of the Bargaining Unit and the matter may be taken up as a Board Grievance.thirty

Union Rights. 5.1 The Company agrees to the posting by the Union on a bulletin board of announcements regarding elections, meetings, negotiations, developments and internal affairs of the Union. There will be one bulletin board upon which the Union can post notices with the Company's advance consent. Such consent will not be unreasonably withheld.
5.2 Upon reasonable advance notice by the Union, the Company will release up to three employees named by the Union to attend negotiation meetings. The employees named by the Union to attend negotiation meetings will each be granted one day in order to attend a pre- negotiation Union meeting, during each round of bargaining. The Union will provide the Company with three weeks' notice of such pre-negotiation date. It is understood that all union leaves shall notify be subject to operational requirements.
5.3 Leave without pay will be granted to any employee duly authorized to represent employees in order to attend executive council meetings, labour conventions, congress, etc. A request for such leave shall be submitted in writing at least twenty (20) days in advance, and such
(a) An employee will be granted leave without pay to accept a position with the BoardUnion, in writingfor up to six months. Such leave shall be granted by the Company on receipt of a written request from the employee and the president of the Union.
5.4 Since the ▇▇▇▇▇▇▇'▇ first obligation is the performance of their duties to their employer, it is agreed that Union business is to be conducted outside of the employee's working hours unless it cannot reasonably be done outside of the working hours. If it must be done within working hours, the ▇▇▇▇▇▇▇ will obtain approval from their supervisor so as not to interfere with operations.
5.5 The Company shall provide to the Union one (1) copy of each of the following:
(a) Names Within five (5) business days, notice of its representatives in hiring, dismissal for Regular positions within the Bargaining Unit on bargaining unit, extensions of probationary period and suspensions, but failure to provide such notice will not nullify the Executivesuspension or discharge, Collective Bargaining Committee and Grievance Officerbut will extend the time to grieve until seven (7) days after notification is received.
(b) Address Prior to negotiations, upon request by the Union, a list of bargaining unit employees including current base wage and phone number of its Head Office
(c) Address and phone number of the Bargaining Unit Office
5.2 The Board shall advise the President of the Bargaining Unit, in writing, of each new Member’s name and work location within thirty (30) working days of commencement of employment of the new Member.

5.6 The Union may use Paid Education Leave – Commencing October 9, 2018 the inter-office mail service and electronic mail Employer agrees to pay into a special fund an amount of one cent (.01¢) per hour for all regular hours to provide for the purpose Unifor Paid Education Leave (PEL) program. On June 1, 2020 the Employer agrees to pay into the special fund an amount of communicating with its Memberstwo cents (.02¢) per hour for all regular hours. If On June 1, 2021 the Board believes Employer agrees to pay into the use special fund an amount of three cents (.03¢) per hour for all regular hours. Such payment will be remitted in the first quarter of the services is being misusedyear into a trust fund established by the Unifor National Union effective from date of ratification. 5.5 5.06 The Union agrees not shall be provided with access to engage in Union activities during normal working hours, except bulletin board space for normal break periods. The Union further agrees not to hold Union meetings on the premises posting of P.S.S.P. notices at the Board without prior permission of the Manager, Employee Relations or designate unless otherwise provided in this AgreementEducation Centre.
5.6 5.07 The Union may use the inter-office mail service and electronic mail for the purpose of communicating with its Members. If the Board believes the use of the services is being misused, the Manager, Employee Relations Human Resources shall so notify the President of the Bargaining Unit and the matter may be taken up as a Board Grievance.
5.08 (a) Any official correspondence from the Board to the Union or the Bargaining Unit shall be sent to the President of the Bargaining Unit at the address of the office of the Bargaining Unit provided in clause 5.1 unless otherwise stated in this Agreement.
