Union Responsibilities. Except for claims resulting from errors caused by defective City equipment, the Union agrees to indemnify and hold harmless the City for any loss or damage arising from the operation of this Article.

The Union shall keep an adequate itemized record of its financial transactions and shall make available annually to the City Clerk, and to all unit employees, within sixty (60) calendar days after the end of its fiscal year, a detailed written financial report thereof in the form of a balance sheet and an operating statement, certified as to its accuracy by its president and the treasurer or corresponding principal officer, or by a certified public accountant.

The Union shall not be liable to the County for "wildcat" job action by the employees it represents unless the Union fails to use its best efforts to end such "wildcat" job action by encouraging its members to discontinue the job action; immediately declaring in writing delivered to the County and vigorously publicizing that such job action is illegal and unauthorized; and directing its members in writing to cease such conduct and resume work.

Such formula must be comparable with the County payroll system. Any changes in the amount of dues/fees will be certified to the County by the Union, and shall become effective no later than thirty (30) days following the date that the County receives such certification from the Union. Additionally, the Union agrees to furnish any information needed by the County to fulfill the provisions of this Section. The Union shall comply with all applicable statutory and case law in administering this section.

Upon notification in writing by the County to the 11 Union that any of its members are engaged in a work stoppage, the Union shall immediately, in 12 writing, order such members to immediately cease engaging in such work stoppage and provide the 13 County with a copy of such order. In addition, if requested by the County, a responsible official of 14 the signatory organization shall publicly order such signatory organization employees to cease 15 engaging in such a work stoppage.

The Union certifies to the County that within thirty (30) days of the effective date of this agreement, it shall adopt, implement and will maintain constitutionally acceptable procedures to enable non-member Agency Fee payers to meaningfully challenge the propriety of the uses to which Agency Fees are put. Those procedures shall be in accordance with the decision of the United States Supreme Court in Chicago Teachers Union, Local No. 1, AFT, AFL-CIO et al. x. Xxxxxx, 106 S. CT. 1066 (1986).
