Understanding and expectations. The remedies described in this Article are directed to MA Dual SNP’s timely and responsive performance of this Agreement, and the creation of a flexible and responsive relationship between the parties. Performance reviews may be conducted at the discretion of HHSC at any reasonable time and may relate to any responsibility or requirement of the MA Dual SNP under this Agreement. Understanding and expectations. (a) CONTRACTOR agrees and understands that HHSC may pursue contractual remedies for both programmatic and financial noncompliance. HHSC, in its discretion, may impose or pursue one or more remedies for each item of noncompliance and will determine sanctions on a case-by-case basis. HHSC's pursuit or non-pursuit of a tailored administrative remedy shall not constitute a waiver of any other remedy that HHSC may have at law or equity.
