Common use of Underground Tanks Clause in Contracts

Underground Tanks. If underground or other storage tanks storing Hazardous Materials located on the Premises or the Project are used by Tenant or are hereafter placed on the Premises or the Project by Tenant, Tenant shall monitor such storage tanks, maintain appropriate records, implement reporting procedures, properly close any underground storage tanks, and take or cause to be taken all other actions necessary or required under applicable state and federal law, as such now exists or may hereafter be adopted or amended in connection with the use, maintenance, operation and closure of such storage tanks.

If underground or other storage tanks storing Hazardous Materials are located on the Demised Premises or the Project are used by Tenant or are hereafter placed on the Demised Premises at the request of or for the Project by benefit of Tenant, Tenant shall monitor such the storage tanks, maintain appropriate records, implement reporting procedures, properly close any underground storage tanks, and take or cause to be taken all other actions steps necessary or required under all applicable local, state and federal law, laws and regulations as such they now exists exist or may hereafter be adopted or amended in connection with the use, maintenance, operation and closure of such storage tanksamended.
