Underground Damage. Operator shall release Contractor and its suppliers, contractors and subcontractors of any tier of any liability for, and shall protect, defend and indemnify Contractor and its suppliers, contractors and subcontractors of any tier from and against any and all claims, liability, and expense resulting from operations under this Contract on account of injury to, destruction of, or loss or impairment of any property right in or to oil, gas, or other mineral substance or water, if at the time of the act or omission causing such injury, destruction, loss, or impairment, said substance had not been reduced to physical possession above the surface of the earth, and for any loss or damage to any formation, strata, or reservoir beneath the surface of the earth.
Underground Damage. Operator shall at all times be responsible for and hold harmless and indemnify Contractor and its suppliers, contractors and subcontractors of any tier from and against any and all claims on account of injury to, destruction of, or loss or impairment of any property right in or to oil, gas or other mineral substance or water, if at the time of the act or omission causing such injury, destruction, loss, or impairment, said substance had not been reduced to physical possession above the seabed, and for any loss or damage to any formation, strata, or reservoir beneath the seabed.
Underground Damage. 18.1 Operator agrees to indemnify and hold Contractor harmless from any and all claims against Contractor based on any incidents arising out of or occurring during the term of this Agreement on account of injury to, destruction of or loss or impairment of any property rights in or to oil, gas or other mineral substance or water if at the time of the act or omission causing such injury, destruction, loss or impairment such substances had not been reduced to physical possession above the surface of the earth, and including any loss or damage to any formation strata or reservoir beneath the surface of the earth.

Underground Damage. Notwithstanding anything in this Agreement to the contrary, Company assumes liability for and shall indemnify, defend and hold Contractor harmless from and against the loss of, injury to, damage to or impairment of any geological formation, strata or reservoir beneath the surface of the earth or property right in or to any oil, gas or geothermal reservoir beneath the surface of the earth, which shall also include the loss of any such oil and/or gas and/or geothermal water which escapes above or below the surface, unless the loss, injury, damage or impairment was caused by Contractor’s (Group) Gross Negligence or Wilful Misconduct.
Underground Damage. Operator shall release Contractor Group and each of their equipment manufacturers, suppliers, contractors and subcontractors of any tier of any liability for, and shall protect, defend and indemnify Contractor Group and each of their equipment manufacturers, suppliers, contractors and subcontractors of any tier from and against any and all claims, liability, and expense resulting from operations under this Contract on account of injury to, destruction of, or loss or impairment of any property right in or to oil, gas, or other mineral substance or water, if at the time of the act or omission causing such injury, destruction, loss, or impairment, said substance had not been reduced to physical possession above the surface of the earth, and for any loss or damage to any property, equipment, structure, formation, strata, or reservoir beneath the surface of the earth.
Underground Damage. Notwithstanding any provision to the contrary contained herein, CUSTOMER shall release CONTRACTOR of any liability for, and shall protect, defend and indemnify CONTRACTOR from and against any and all claims, penalties, liability, and expense resulting from operations under this Agreement on account of injury to, destruction of, or loss or impairment of or related to any property right in or to oil, gas, or other mineral substance or water, well, pipeline, coal mine, or other facility where Services are being performed, the cost to redrill or sidetrack the existing wellbore, if at the time of the act or omission causing such injury, destruction, loss, or impairment, said substance had not been reduced to physical possession above the surface of the earth, and for any loss or damage to any geologic formation, strata, wellbore, pipeline (including compressor stations and other equipment associated with the pipelines), refineries, or reservoir beneath the surface of the earth.
