Uncovering. If a portion of the Work is covered contrary to the Owner's written request (such notice to be given in sufficient time in advance so as not to delay the Work) or to requirements of the Contract Documents, it must, if required in writing by the Owner, be uncovered for the Owner's observation and be replaced without change in the Schedule or GMP; the costs of such uncovering and replacement shall be Cost of the Work, subject to the limitation set forth in Section 2.22 hereof.

Uncovering. If a portion of the Construction Work is covered contrary to the Owner's written request or to requirements of the Contract Documents, it must, if required in writing by the Owner, be uncovered for the Owner's observation and be replaced without change in the Schedule or Contract Price; the costs of such uncovering and replacement shall be included in the Contract Price.
Uncovering. Should any of the work of this Section be covered up or enclosed before it has been completely inspected, tested, and approved, do all things necessary to uncover all such work. After the work has been completely inspected, tested and approved, provide all materials and labor necessary and make all repairs necessary to restore the work to its original and proper condition at no additional cost to the Owner.

Uncovering. (a) No portion of the Work that has been designed as a hold point pursuant to the inspection and test plan agreed to by the Parties shall be covered contrary to the requirements of this Agreement and prior to giving Owner reasonable opportunity to inspect such portion of the Work, subject where applicable to the provisions of Section 2.24.3 or 2.24.4. If any such portion of the Work should be covered contrary to the foregoing sentence, it must, if required in writing by Owner, be uncovered for inspection and subsequently be recovered, all at Contractor’s expense.

All porous exterior surfaces (e.g. unpainted wood) shall be sealed with 2 coats of Xxxxxxxx’x Water Seal following the manufacturers application instructions. Interior surfaces requiring paint shall be prime coated plus 2 coats of Xxxxxxx Xxxxxxxx Pro-Mar Latex Eg-Shel enamel. Concrete block walls shall receive 1 coat of Xxxxxxx Xxxxxxxx Pro-Mar Block Filler and 2 coats of Xxxxxxx Xxxxxxxx Pro-Mar latex Eg-Shel enamel. Interior finishes and color selections shall be approved by the State. A schedule of colors and finishes shall be prepared by the Owner/Lessor and approved by the State.

  • Compatibility 1. Any unresolved issue arising from a mutual agreement procedure case otherwise within the scope of the arbitration process provided for in this Article and Articles 25A to 25G shall not be submitted to arbitration if the issue falls within the scope of a case with respect to which an arbitration panel or similar body has previously been set up in accordance with a bilateral or multilateral convention that provides for mandatory binding arbitration of unresolved issues arising from a mutual agreement procedure case.
