Common use of Uncontrollable Event Clause in Contracts

Uncontrollable Event. Except for the Town’s obligation to pay amounts due under this Agreement, any failure or delay in performance under this Agreement by either party due to an Uncontrollable Event shall not constitute a breach of this Contract, but shall entitle the affected party to be relieved of performance under this Contract during the term of such event and for a reasonable time thereafter.
