Uncertainty. If the Executive is uncertain whether: (a) particular information is the Employer’s Confidential Information; or (b) particular information is publicly available; the information is taken to be the Employer’s Confidential Information and is taken not to be publicly available unless the Employer informs the Executive in writing to the contrary.
