Common use of Unbundled Loop Modifications (Line Conditioning Clause in Contracts

Unbundled Loop Modifications (Line Conditioning. 2.5.1 Line Conditioning is defined as the removal from the Loop of any devices that may diminish the capability of the Loop to deliver high-speed switched wireline telecommunications capability, including xDSL service. Such devices include, but are not limited to, load coils, bridged taps, low pass filters, and range extenders. 2.5.2 BellSouth shall condition Loops, as requested by Talk America, whether or not BellSouth offers advanced services to the End User on that Loop. 2.5.3 In some instances, Talk America will require access to a copper twisted pair loop unfettered by any intervening equipment (e.g., filters, load coils, range extenders, etc.), so that Talk America can use the loop for a variety of services by attaching appropriate terminal equipment at the ends. Talk America will determine the type of service that will be provided over the loop. BellSouth’s Unbundled Loop Modifications (ULM) process will be used to determine the costs and feasibility of conditioning the loops as requested. Rates for ULM are as set forth in Exhibit B of this Attachment. 2.5.4 In those cases where Talk America has requested that BellSouth modify a Loop so that it no longer meets the technical parameters of the original Loop type (e.g., voice grade, ISDN, ADSL, etc.) the resulting modified Loop will be ordered and maintained as a UCL. 2.5.5 The Unbundled Loop Modifications (ULM) offering provides the following elements: 1) removal of devices on 2-wire or 4-wire Loops equal to or less than 18,000 feet; 2) removal of devices on 2-wire or 4-wire Loops longer than 18,000 feet; and 3) removal of bridged-taps on loops of any length. 2.5.6 Talk America shall request Loop make up information pursuant to this Attachment prior to submitting a service inquiry and/or a LSR for the Loop type that Talk America desires BellSouth to condition.

If a spare loop facility that meets the loop modification specifications requested by <customer name> is available at the location for which the ULM was requested, <customer name> will have the option to change the loop facility to the qualifying spare facility rather than to provide ULM. In the event that BellSouth changes the loop facility in lieu of providing ULM, <customer name> will not be charged for ULM but will only be charged the service order charges for submitting an order.

If a spare loop facility that meets the loop modification specifications requested by Creative Telecom is available at the location for which the ULM was requested, Creative Telecom will have the option to change the loop facility to the qualifying spare facility rather than to provide ULM. In the event that BellSouth changes the loop facility in lieu of providing ULM, Creative Telecom will not be charged for ULM but will only be charged the service order charges for submitting an order.

Unbundled Loop Modifications (Line Conditioning. 2.5.1 Line Conditioning is defined as the removal from the Loop of any devices that may diminish the capability of the Loop to deliver high-speed switched wireline telecommunications capability, including xDSL service. Such devices include, but are not limited to, load coils, bridged taps, low pass filters, and range extenders. 2.5.2 BellSouth shall condition Loops, as requested by Talk AmericaFTS, whether or not BellSouth offers advanced services to the End User on that Loop. 2.5.3 In some instances, Talk America FTS will require access to a copper twisted pair loop unfettered by any intervening equipment (e.g., filters, load coils, range extenders, etc.), so that Talk America FTS can use the loop for a variety of services by attaching appropriate terminal equipment at the ends. Talk America FTS will determine the type of service that will be provided over the loop. BellSouth’s Unbundled Loop Modifications (ULM) process will be used to determine the costs and feasibility of conditioning the loops as requested. Rates for ULM are as set forth in Exhibit B of this Attachment. 2.5.4 In those cases where Talk America FTS has requested that BellSouth modify a Loop so that it no longer meets the technical parameters of the original Loop type (e.g., voice grade, ISDN, ADSL, etc.) the resulting modified Loop will be ordered and maintained as a UCL. 2.5.5 The Unbundled Loop Modifications (ULM) offering provides the following elements: 1) removal of devices on 2-wire or 4-wire Loops equal to or less than 18,000 feet; 2) removal of devices on 2-wire or 4-wire Loops longer than 18,000 feet; and 3) removal of bridged-taps on loops of any length. 2.5.6 Talk America FTS shall request Loop make up information pursuant to this Attachment prior to submitting a service inquiry and/or a LSR for the Loop type that Talk America FTS desires BellSouth to condition. 2.5.7 When requesting ULM for a loop that BellSouth has previously provisioned for Florida Telephone Services, L.L.C., Florida Telephone Services, L.L.C. will submit a service inquiry to BellSouth. If a spare loop facility that meets the loop modification specifications requested by Florida Telephone Services, L.L.C. is available at the location for which the ULM was requested, Florida Telephone Services, L.L.C. will have the option to change the loop facility to the qualifying spare facility rather than to provide ULM. In the event that BellSouth changes the loop facility in lieu of providing ULM, Florida Telephone Services, L.L.C. will not be charged for ULM but will only be charged the service order charges for submitting an order.

Unbundled Loop Modifications (Line Conditioning. 2.5.1 Line Conditioning is defined as the removal from the Loop of any devices that may diminish the capability of the Loop to deliver high-speed switched wireline telecommunications capability, including xDSL service. Such devices include, but are not limited to, load coils, bridged taps, low pass filters, and range extenders. 2.5.2 BellSouth shall condition Loops, as requested by Talk AmericaBTI, whether or not BellSouth offers advanced services to the End User on that Loop. 2.5.3 In some instances, Talk America BTI will require access to a copper twisted pair loop unfettered by any intervening equipment (e.g., filters, load coils, range extenders, etc.), so that Talk America BTI can use the loop for a variety of services by attaching appropriate terminal equipment at the ends. Talk America BTI will determine the type of service that will be provided over the loop. BellSouth’s Unbundled Loop Modifications (ULM) process will be used to determine the costs and feasibility of conditioning the loops as requested. Rates for ULM are as set forth in Exhibit B of this Attachment. 2.5.4 In those cases where Talk America BTI has requested that BellSouth modify a Loop so that it no longer meets the technical parameters of the original Loop type (e.g., voice grade, ISDN, ADSL, etc.) the resulting modified Loop will be ordered and maintained as a UCL. 2.5.5 The Unbundled Loop Modifications (ULM) offering provides the following elements: 1) removal of devices on 2-wire or 4-wire Loops equal to or less than 18,000 feet; 2) removal of devices on 2-wire or 4-wire Loops longer than 18,000 feet; and 3) removal of bridged-taps on loops of any length. 2.5.6 Talk America BTI shall request Loop make up information pursuant to this Attachment prior to submitting a service inquiry and/or a LSR for the Loop type that Talk America BTI desires BellSouth to condition.

If a spare loop facility that meets the loop modification specifications requested by Speedy Reconnect is available at the location for which the ULM was requested, Speedy Reconnect will have the option to change the loop facility to the qualifying spare facility rather than to provide ULM. In the event that BellSouth changes the loop facility in lieu of providing ULM, Speedy Reconnect will not be charged for ULM but will only be charged the service order charges for submitting an order.

If a spare loop facility that meets the loop modification specifications requested by <customer name> is available at the location for which the ULM was requested, <customer name> will have the option to change the loop facility to the qualifying spare facility rather than to provide ULM. In the event that BellSouth changes the loop facility in lieu of providing ULM, <customer name> will not be charged for ULM but will only be charged the service order charges for submitting an order.

In the event that BellSouth changes the loop facility in lieu of providing ULM, EPICUS will not be charged for ULM but will only be charged the service order charges for submitting an order.
