Unavoidable Circumstances. A short-term leave of absence without loss of salary for up to, but not exceeding, one (1) day may be granted by the Superintendent of Human Resources for absence due to unavoidable circumstances such as inclement weather, impassable roads, or other transportation failures and acts of God. The maximum number of days granted for this leave is two (2) days per calendar year.

Unavoidable Circumstances. No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations of Buyer to make payments to Seller hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party's ("Impacted Party") control, including, without limitation, the following force majeure events ("Force Majeure Event(s)"): acts of God, acts or threats of war or terrorism, riot, embargoes, acts of civil or military authorities, fires, floods, accidents, quarantine restrictions, pandemics, mill condition, strikes, differences with workmen, delays in transportation, shortage of cars, fuel, labor or materials, or any other cause beyond the reasonable control of the Impacted Party. Seller shall not be liable for its failure to perform hereunder if due to any shortage or inability to obtain (on terms deemed economically and/or commercially impracticable by Seller) any raw material (including energy), equipment, or transportation. Any quantities not delivered or accepted because of any such contingency shall be eliminated from the Sales Confirmation. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. Buyer acknowledges that all Orders are accepted with the understanding that they are subject to Seller's ability to obtain the necessary raw materials, and all Orders as well as shipments of Products are subject to Seller's factory schedules, governmental priorities (such as rated orders), and other government regulations, orders, directives and restrictions that may be in effect from time to time. Seller shall have no liability to Buyer for any delays caused by an inability to obtain the necessary raw materials. During any period when Seller is unable to supply the Sales Confirmation quantity of the Goods, whether caused by the circumstances above or otherwise, Seller may allocate any available goods among its customers, including its own subsidiaries, divisions, and departments, on such basis as Seller deems fair and reasonable. Unavoidable Circumstances. If options 1 and 2 above are not possible and it is deemed necessary by your doctor that medication be brought to school, preauthorization must be obtained from the school office in advance. This includes all types of medicine and medical devices, including asthma inhalers and EpiPens. Please contact the office by telephone or e-mail to explain your situation. When the approval is granted, a parent or guardian will complete and submit the TIPS form “In School Medication Authorization and Release of Liability '' to our office. Students will: ● Bring the medication to the school office upon arrival for filing and storage. ● Come to the school office at the correct time to self-administer the medicine under the staff’s supervision. Students will take responsibility for arriving at the correct time and taking the correct dosage. With the school’s knowledge, a student may keep life-saving emergency medication such as an EpiPen or an inhaler for easy and quick access, as well as it being stored at the school office.
Unavoidable Circumstances. Neither party shall be responsible for delays or failures in performance resulting from acts of God, acts of civil unrest or military authority, fire, flood, strikes, war, epidemics, pandemics, shortage of power or other acts or causes reasonably beyond the control of that party. The party experiencing such an event agrees to give the other party notice promptly following such occurrence, and to use diligent efforts to resolve disruptions or performance issues as promptly as reasonably practicable.
Unavoidable Circumstances. Any failure to meet obligations with respect to timing set forth in this Agreement due to circumstances beyond WM Direct’s or its affiliates’ reasonable control shall not be considered a breach. Without limiting the generality of the foregoing, in the event that any subcontractor utilized by WM Direct to provide AD is unable to provide AD in the regular course of its business as needed in order for WM Direct to satisfy any of its obligations hereunder with respect to providing AD, WM Direct’s failure to meet such obligation will not be considered a breach of this Agreement; provided, that WM Direct provides Claimants’ Counsel with reasonable notice of such event and takes commercially reasonable steps to mitigate.
Unavoidable Circumstances. 26.1 In the event that, due to circumstances beyond the reasonable control of the Foundation, the hiring is unable to proceed, the Foundation shall reimburse the hirer all sums received from the hirer in respect of the hiring concerned but the Foundation shall not be liable to make any further payment to the hirer by way of compensation for any resultant loss or damage suffered or incurred.

Without limiting the generality of the foregoing, Landlord shall not be liable if any such unavoidable circumstances prevent it from delivering Expansion Space to Tenant in a timely manner.
