TRANSPORTATION; DELIVERY. (a) Delivery dates are firm and TIME IS OF THE ESSENCE WITH RESPECT TO DELIVERY. Seller will promptly notify Buyer in writing if Seller anticipates difficulty in complying with a required delivery date and will use all commercially reasonable efforts to meet the required delivery date. Buyer has no obligation to accept deliveries that are not made on the required delivery date. If Seller fails to meet a required delivery date, Buyer may procure replacement products or services. Seller will be responsible for all costs incurred by Xxxxx as a result of early or late deliveries. If Seller has to use premium freight, Seller will notify Buyer in writing of the type and monetary value of the premium freight used (for Buyer’s records).

TRANSPORTATION; DELIVERY. Time is of the essence in the performance of all of Seller’s obligations, including, but not limited to, deliveries under this PO. Delivery will be strictly in accordance with Buyer’s schedule. If, in order to comply with Buyer’s required delivery date, it becomes necessary for Seller to ship by a more expensive way than specified in this PO, any increased costs resulting because of the delay shall be paid for by Seller. Seller will immediately notify Buyer of any delays in shipments of goods. Unless otherwise specified in this PO, the prices stated include packing, insurance, freight and delivery FOB (Free On Board) to the address specified by Buyer. When authorized to prepay and xxxx, the Seller must submit a copy of the paid freight xxxx or equivalent with the invoice. If Buyer reasonably believes deliveries would not be so made, Buyer may, in addition to other rights and remedies it may have, terminate all or part of this PO for cause.
TRANSPORTATION; DELIVERY. As a matter of principle, the supplier is only allowed to deliver defect-free products as the incoming inspection of SUSPA normally only includes an identification, visual and quantity check. SUSPA must always be able to use the received goods in the production without an incoming inspection. The supplier must label each packing unit with the quantity and the SUSPA part num- ber as well as the production date and lot number. All shipments must be clearly trace- able by the data on the delivery note. The supplier commits himself to adhere to his de- livery obligation by 100%. By suitable pack- ing, the supplier must assure that the quality of the products is not affected in conse- quence of the transport to SUSPA. The sup- plier must fill out delivery documents com- pletely and correctly. After a change or revision, the supplier must mark the first three deliveries with distinct la- bels, for example F0603.20. This allows SUSPA to handle these deliveries in a special way, if needed. The supplier must keep records of additional freight charges, special occurrences, and causes (for extra shipments). The records must show both the charges covered by the supplier and by the sub-suppliers.

Unloading, haulage from the designated unloading point and further necessary handling shall be at the Purchaser’s risk and expense, independent of any installation services that may be requested by the Purchaser.

In the event the Purchaser fails to supply delivery instructions, the Seller at its option may place the Equipment in the Seller’s or any public or private storage facilities at the Purchaser’s risk and expense and the Seller will invoice the Purchaser for all such costs.

TRANSPORTATION; DELIVERY. CONTRACTOR shall place Containers (including Carts and Dumpsters), bags, and/or cardboard boxes, in a safe and accessible location. CONTRACTOR shall provide notice of the proposed locations to Director for approval prior to implementing service. At any time, Director reserves the right to change the proposed locations or require CONTRACTOR to place them at a particular location. There are two options for Containers, those left at the location overnight and those placed during business hours. Director will indicate which is needed. For those not left overnight, CONTRACTOR shall either deliver the Containers between 6 and 7
