Transfer of Customer Data. In the event this Agreement is terminated or a successor to the Agent is appointed, the Agent shall, at the expense of the Trust, transfer to such designee as the Trust may direct a certified list of the shareholders of the Trust serviced by the Agent (with name, address and tax identification or Social Security number, if any), a complete record of the account of each such shareholder and the status thereof, and all other relevant books, records, correspondence, and other data established or maintained by the Agent under this Agreement. In the event this Agreement is terminated, the Agent will use its best efforts to cooperate in the orderly transfer of such duties and responsibilities, including assistance in the establishment of books, records and other data by the successor.
Transfer of Customer Data. In the event this Agreement is terminated or a successor to the Agent is appointed, or another party is engaged by the Trust to provide some or all of the services enumerated in Section 2 of this Agreement, the Agent shall, at the expense of the Trust, transfer to such designee as the Trust may direct a certified list of shareholders of the Trust as to whom the Agent provides services hereunder (with name, address and tax identification or Social Security number), a complete record of the account of each such shareholder and the status thereof, and all other relevant books, records, correspondence, and other data established or maintained by the Agent under this Agreement. In the event this Agreement is terminated, the Agent will use its best efforts to cooperate in the orderly transfer of such duties and responsibilities, including assistance in the establishment of books, records and other data by the successor.
Transfer of Customer Data. In the event this Agreement is terminated or is assigned pursuant to Section 19 hereof, the Organization shall transfer to its successor or to such designee as the Fund Company may direct a certified list of the shareholders of the Fund Company serviced by the Organization (with name, address and tax identification or Social Security number, if any), a complete record of the account of each such shareholder and the status thereof, and all other relevant books, records, correspondence, and other data established or maintained by the Organization under this Agreement and will use its best efforts to cooperate in the orderly transfer of its duties and responsibilities under this Agreement to such successor or designee, including assistance in the establishment of books, records and other data by the successor or designee.

In the event this Agreement is terminated or a successor to the Shareholder Servicing Agent is appointed, the Shareholder Servicing Agent shall, at the expense of the Company, transfer to such successor as the Company may designate a certified list of the beneficial owners of shares of the Company serviced by the Shareholder Servicing Agent (with name, address and tax identification or Social Security number), a complete record of the account of each such shareholder and the status thereof, and all other relevant books, records, correspondence, and other data established or maintained by the Shareholder Servicing Agent under this Agreement. In the event this Agreement is terminated, the Shareholder Servicing Agent will use its best efforts to cooperate in the orderly transfer of such duties and responsibilities to the successor, including assistance in the establishment of books, records and other data by the successor.
Transfer of Customer Data. If Customer transfers any personal data to CA in connection with the SaaS, and/or provides CA access to any SaaS Customer Data, then Customer warrants that (i) it is duly authorized to provide personal data to CA and it does so lawfully in compliance with relevant legislation, (ii) CA and its Affiliates or its subcontractors, acting on behalf of CA, may use such data strictly for the purposes of performing its obligations under this Agreement, and (iii) CA may disclose such data to any CA entity and its subcontractors for this purpose and may transfer such data to countries outside of the country of origin. CA and its affiliates have committed to comply with relevant data protection/privacy legislation, and personal data will be transferred in accordance with CA’s statement and terms set out at xxxxx://xxx.xx.xxx/us/legal/privacy/data-transfers.html. Customer agrees not to provide any health, payment card or similarly sensitive personal information that imposes specific data security obligations for the processing of such data unless it is a supported feature in the Documentation of the applicable SaaS offering.
Transfer of Customer Data. Transfer of Customer Data. You agree that the Customer Data may be transferred or stored outside the country where You and Your customers are located in order to carry out the Services and Our other obligations under the Agreement.
Transfer of Customer Data. The customer accepts the electronic transfer of the customer data (encrypted by MOUNT10) through a public network infrastructure (Internet). The customer is carrying the risk of a potential data loss during transport. The responsibility of MOUNT10 for the customer data starts with the arrival at SWISS FORT XXXX and lasts until the data is leaving SWISS FORT XXXX again. MOUNT10 guarantees the legal obligations of secrecy (professional secrecy for medical, legal and federal employees) and to ensure these obligations amongst all employees through secrecy statements in writing.

In the event this Agreement is terminated, you will use your best efforts to cooperate in the orderly transfer of such duties and responsibilities, including assistance in the establishment of books, records and other data by the successor.
