In providing services and in participation in the activities of the Program, \u2587\u2587\u2587\u2587\u2587\u2587\u2587 agrees to do the following:\n2.1. \u2587\u2587\u2587\u2587 and adhere to the Medical Staff Bylaws, the policies and practices of DUHS, Hospital, and Program (accessible at https.//\u2587\u2587\u2587.\u2587\u2587\u2587\u2587.\u2587\u2587\u2587/\u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2587), the policies and requirements of all of the facilities to which Trainee is assigned for clinical rotations, the standards of all accrediting certifying or licensing organization, and all applicable state, federal and local laws, including all public health requirements or orders;\n2.2. Participate fully in the educational, research and scholarly activities as assigned by the Institution and Program (and/or as necessary for the completion of applicable graduate requirements), attend all required educational conferences, assume responsibility for teaching and supervising other trainees and students, and participate in assigned DUHS, Hospital, Medical Staff committee activities;\n2.3. Use their best efforts to provide safe, effective and compassionate patient care, and present at all times a courteous and respectful attitude toward all patients, colleagues, employees, visitors at DUHS and other facilities/rotation sites to which Trainee is assigned. This provision includes compliance with the dress code applicable to DUHS trainees;\n2.4. Satisfactorily fulfill the educational requirements of the Program in a timely manner;\n2.5. Provide clinical services:\n2.5.1. As and when assigned\n2.5.2. Commensurate with their level of advancement and responsibilities;\n2.5.3. Under appropriate supervision;\n2.5.4. At sites specifically approved by the Program and Office of Graduate Medical Education; and\n2.5.5. Under circumstances and at locations covered by the Hospital's professional liability insurance maintained for Trainee in accordance with Section 5.4 below.\n2.6. To the satisfaction of the Program Director, demonstrate competency in Patient Care, Medical Knowledge, Interpersonal and Communication Skills, Practice Based Learning and Improvement, Professionalism, and Systems Based Practice, as determined by the Program in its sole discretion, for \u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2019s level of training;\n2.7. Cooperate fully as follows:\n2.7.1. Coordinate and complete the required submissions and activities including the legible and timely completion of patient medical records, charts, reports, statistical operative and procedure logs and/or other clinical documentation required by the ACGME, Hospital, DUHS, Department and Program, and comply with any requirements for use of any third party applications, programs, or platforms specified by Hospital, DUHS, Department, or Program for these purposes;\n2.7.2. Immediately report to the Office of Graduate Medical Education, any investigation or correspondence regarding issues that may impact state licensure, including but not limited to reporting within seven (7) days any arrest for driving while impaired or driving under the influence; and\n2.7.3. Cooperate with the North Carolina Medical Board or any other state medical board with respect to any investigation that may impact state licensure.\n2.8. Return at the time of the expiration or termination of the Agreement, all Hospital property, including but not limited to books, equipment, and pager; complete all necessary records; and settle all professional and financial obligations;\n2.9. Comply with and complete all required Hospital, Department and Program surveys, reviews, evaluations, quality assurance and credentialing activities;\n\u2587.\u2587\u2587. \u2587\u2587\u2587\u2587\u2587\u2587 immediately: a) to DUHS Risk Management or the Office of General Counsel any inquiry by any private or governmental attorney or investigator (including, without limitation, inquiries related to services provided at the Veteran\u2019s Administration, or any other clinic, facility, or training site), or b) to the Duke Health News Office any inquiry by any member of the press. \u2587\u2587\u2587\u2587\u2587\u2587\u2587 understands that the Hospital encourages \u2587\u2587\u2587\u2587\u2587\u2587\u2587's full cooperation with any governmental investigation or inquiry. \u2587\u2587\u2587\u2587\u2587\u2587\u2587 agrees not to communicate with any inquiring private attorney or any members of the press regarding patient or clinical matters or any other confidential DUHS or Hospital matters, except merely to refer such private attorneys to DUHS Risk Management and/or Office of University Counsel and to refer members of the press to Duke Health News Office;\n2.11. Cooperate fully with Hospital administration, including but not limited to the departments of Nursing, Professional Services, Financial Services, Social Services, and other ancillary services departments in connection with the evaluation of appropriate discharge and post-hospital care for hospital patients;\n2.12. Comply with Hospital institutional policies prohibiting discrimination and harassment. \u2587\u2587\u2587\u2587\u2587://\u2587\u2587.\u2587\u2587\u2587\u2587.\u2587\u2587\u2587/policies/diversity/harassment-discrimination;\n2.13. Permit and assist the Hospital to obtain from and provide to all proper parties (e.g., government officers, licensing agency officials or officers, bona fide third party employers seeking information regarding credentialing or privileges, or other similar parties) any and all information as required or authorized by law or by any accreditation body. The Trainee covenants to hold harmless the Hospital, its officers, directors, or other personnel for good faith compliance with such requests for information. This covenant shall survive termination or expiration of this Agreement;\n2.14. Maintain required immunizations consistent with DUHS policy and all applicable federal, state, and local laws and regulations; and\n2.15. providing services and in participating in the activities of the Program, the Trainee agrees to do the following:\n2.1 Comply fully with the policies and procedures of the organized Medical Staff for the delivery of clinical care and exercise of care decision-making responsibilities, as well as the general policies, procedures, guidelines and directives of \u2587\u2587\u2587\u2587 Israel Deaconess Medical Center, including, but not limited to, the Medical Center\u2019s policies and standards applicable to GMEC-approved non-ACGME training programs, and the Medical Center\u2019s policies prohibiting discrimination and sexual harassment. The Medical Center policy PM-09 Sexual Harassment is attached, and the Trainee must acknowledge receipt of the Sexual Harassment Policy when submitting the executed Agreement.\n2.2 Obey and adhere to all applicable state, federal and local laws and regulations, as well as the standards required to maintain accreditation by The Joint Commission (\u201cTJC\u201d), and any other relevant accrediting, certifying, or licensing organization.\n2.3 Participate, as assigned by the Program Director, in required educational and scholarly activities of the Program, including the performance of scholarly and research activities, attend required educational conferences, assume any assigned responsibility for teaching and supervising other residents and students, and participate in assigned Medical Center committee activities.\n2.4 Fulfill the educational requirements of the Program as set forth in the Program-specific Goals and Objectives.\n2.5 Provide clinical service: \uf0a7 Commensurate with his/her level of advancement and responsibilities. \uf0a7 Under appropriate supervision. \uf0a7 At sites specifically approved by the Program. \uf0a7 Fully cooperate with the Program and the Medical Center in coordinating and completing all regulatory submissions and activities, including quality assurance and credentialing, the legible and timely completion of patient medical records, charts, reports, duty hour time logs (if required), statistical operative and procedure logs, faculty and Program evaluations and other documentation required by the Medical Center, Department and/or Program. \uf0a7 Obey and adhere to the Medical Center\u2019s compliance programs and code of conduct.\n2.6 Subsequent to the Commencement Date, submit to periodic health examinations and tests, which may include tests for drug use and/or alcohol abuse that are deemed necessary by the Medical Center to ensure that the Trainee is physically, mentally and emotionally capable of performing essential duties and/or that are otherwise necessary to the operation of the Medical Center.\n2.7 Subsequent to the Commencement Date, keep up to date with all Employee Occupational Health Services requirements for the duration of employment by the Medical Center.
