Common use of Traffic Citations Clause in Contracts

Traffic Citations. No driver shall be required to violate traffic laws or overloading regulations. The Employer shall be responsible for any citations issued unless there is proven gross negligence on the part of the driver. Citations must be submitted to the Employer within for- ty-eight (48) hours and, if not, the Employer shall not be responsi- ble for same. Should the Employer fail to comply with the requirements of this Section, the Employer shall be held responsible for all working time lost or any penalties incurred by reason of the Employer’s fail- ure to comply with this Section. The employee is to be given a receipt showing the citation number, the date the citation was given to the Employer, and the signature of the Employer’s representative receiving it.
