Trade Xxxx. All of Seller's right, title and interest in and to the trade xxxx "A1" and registration number XXXX00000 (including all renewals) and all goodwill relating to or associated with such trade xxxx and trade xxxx registration and the right to xxx for and collect damages for past infringement of such trade xxxx and trade xxxx registration (collectively, the "Trademark").
Trade Xxxx. The Trademark is valid and subsisting and held by Seller with good and marketable title and is in good standing. Seller's use of the Trademark in association with the Business has been continuous and uninterrupted and has not been subject to challenge before the Trade Xxxx Office, nor has the Trademark been the subject of litigation involving Seller, since the assignment of the Trademark effective April 1, 1980 to Canvin Products Ltd., then a wholly owned subsidiary of Seller. To Seller's knowledge, there has not been since April 1, 1980 any objection, challenge, or claim that Seller does not have the right to use the Trademark in association with steak sauce in Canada. For purpose of this Section 4.4 and Sections 4.12 and 4.13 below, "knowledge" means the actual knowledge of the President, any Vice President, the Corporate Secretary, the Assistant Corporate Secretary, and the general manager of the Facility of Seller. 4.5.
Trade Xxxx. The Supplier shall have the right to affix the AMO name, AMO logo, and AMO trade xxxx on the Products.
Trade Xxxx. 11.1 The seller hereby grants to the purchaser a non exclusive, transferable and royalty free license to use the "Spescom" trade xxxx and logo on and in respect of the seller's products and services forming part of the business sold in terms of this agreement.
Trade Xxxx. Use of Trade-Xxxx
Trade Xxxx. Pursuant to Clause 11 of the Global Agreement Shire and Xxxxxxx have agreed that Licensed Product for use in Alzheimer's disease will be marketed under the name Reminyl and accordingly Xxxxxxx undertakes forthwith following signature of this Agreement to execute an assignment of the trade xxxx Reminyl in the UK and Ireland in a form approved by Shire and Xxxxxxx for the purpose.
Trade Xxxx. None of the Seller, the Management Shareholder and/or the Company has applied or authorized any third party to apply any trade xxxx or pattern related to “Giantstone”.
Trade Xxxx. 13.1 XXXXX IMPCO Limited shall register the Trademarks “IMPCO” and “XXXXX-IMPCO”, or such other Trademark as may be mutually decided.
Trade Xxxx. To the extent that the Codes are capable of being so used, Licenser is proprietor of the Trade Xxxx for the Codes in the Territory. Any system showing the FleetNet code as a cross referencing or searching device must display the current FleetNet logo or trademark in a from to be approved by FleetNet.. This will not apply to character based systems, but in this instance the Welcome screen should carry text as approved by FleetNet intimating the code usage and copyright(s) applying thereto.
