Common use of Trade Name Clause in Contracts

Trade Name. In return for the Credit Union agreeing to deal with cheques and other Instruments made payable to, or endorsed in favour of, the trade name noted in this Agreement as though such cheques and other Instruments were made payable to, or endorsed in favour of, the Depositor in the Depositor's name, the Depositor agrees that the Depositor will be liable and responsible to the Credit Union for such cheques and other Instruments as though they were made payable to or endorsed in favour of the Depositor in the Depositor's name. The Depositor hereby agrees to indemnify and save the Credit Union harmless for all liability, costs, damages, and expenses incurred by the Credit Union by reason of the Credit Union dealing with cheques and other Instruments made payable to, or endorsed in favour of, the trade name. This indemnity will enure to the benefit of the Credit Union and will be binding upon the Depositor and the Depositor's successors and assigns.
