Timely Submittal. The Contractor must submit each and all Shop Drawings in a timely manner, with adequate consideration given to construction scheduling requirements so as to allow ample time for checking, correcting, resubmitting, and rechecking of any Shop Drawing by the Architect.

Timely Submittal. Timely submittal and revision of the schedules is essential to ensure the satisfactory prosecution of the work. If the Contractor fails to submit the required schedule within the times stipulated, the Authority, in addition to all other remedies for such Default, may withhold payments otherwise due, and may direct the Contractor to take remedial measures, as provided in these Special Provisions. All schedules submitted shall show the effects of any occurrence upon which the Contractor has based or will base any claim or notice of potential claim for an extension of time, for additional compensation, or for both, and shall expressly call the Authority's attention thereto. Failure to do so in the case of any occurrence shall conclusively preclude the Contractor from asserting any claim for additional compensation, damages or schedule extension.
Timely Submittal. Submit GIS data to the COUNTY by the 10th business day of each month.

  • Treatment of Unallowable Costs Previously Submitted for Payment The Debtors further agree that within 90 days of the Effective Date of this Agreement they shall identify to applicable Medicare and TRICARE fiscal intermediaries, carriers, and/or contractors, and Medicaid and FEHBP fiscal agents, any Unallowable Costs (as defined in this Paragraph) included in payments previously sought from the United States, or any State Medicaid program, including, but not limited to, payments sought in any cost reports, cost statements, information reports, or payment requests already submitted by the Debtors or any of their current subsidiaries or affiliates, and shall request, and agree, that such cost reports, cost statements, information reports, or payment requests, even if already settled, be adjusted to account for the effect of the inclusion of the Unallowable Costs. The Debtors agree that the United States, at a minimum, shall be entitled to recoup from the Debtors any overpayment plus applicable interest and penalties as a result of the inclusion of such Unallowable Costs on previously-submitted cost reports, information reports, cost statements, or requests for payment.   • Administrator Compliance Statement On or before ninety (90) days after the end of each fiscal year, commencing with the fiscal year ended March 31st immediately following the Closing Date, the Administrator shall deliver to the Issuer a statement of compliance addressed to the Issuer and signed by an authorized officer of the Administrator to the effect that (i) a review of the Administrator’s activities during the immediately preceding reporting year (or applicable portion thereof) and of its performance under this Agreement during such period has been made under such officer’s supervision, and (ii) to the best of such officer’s knowledge, based on such review, the Administrator has fulfilled all of its obligations under this Agreement in all material respects throughout such reporting year (or applicable portion thereof) or, if there has been a failure to fulfill any such obligation in any material respect, specifically identifying each such failure known to such officer and the nature and the status thereof. If the Administrator is the same party as the Servicer, such party’s compliance with Section 3.11(a) of the Sale and Servicing Agreement will satisfy the Administrator’s obligations set forth in this Section 1.21(b).
