Time, Place and Condition Clause Samples

Time, Place and Condition. Upon the expiration of the Term or other termination of this Agreement (other than an Event of Loss), Oakley shall return the Aircraft in substantially similar repair, condition and working order as existed on the Delivery Date, ordinary wear and tear excepted, by delivering the Aircraft to N2T, at Oakley’s expense, at Hillsboro, Oregon or at such other location within the forty-eight contiguous United States as specified by N2T. If the delivery location is other than ▇▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇, ▇▇▇ shall specify the delivery location no later than five (5) days prior to the date upon which the Aircraft is due to be returned to N2T. All expenses for delivery and return of the Aircraft shall be borne by Oakley.
