Common use of Time for Delivery Clause in Contracts

Time for Delivery. Seller shall satisfactorily and timely deliver the Supplies in full to the District as specified in the District’s bid package documents for Bid No. 23-24/004 (“Bid Package”), including but not limited to any addenda. Time is of the essence in this Contract. If Seller fails to satisfactorily and timely deliver the Supplies, the District may purchase supplies from other sources and recover damages from Seller as allowed by applicable law, including but not limited to the purchase cost in excess of the contract price (see next section) and other costs incurred due to Seller’s failure to timely deliver.

Time is of the essence in this Contract. If Seller Vendor fails to satisfactorily and timely deliver the SuppliesItems, the District may purchase supplies items from other sources and recover damages from Seller Vendor as allowed by applicable law, including but not limited to the purchase cost in excess of the contract price (see next section) and other costs incurred due to Sellerthe Vendor’s failure to timely deliver.
