The Plan Administrator. The Plan Administrator shall have responsibility and discretionary authority to control the operation and administration of the Plan in accordance with the provisions of Article IX of the Plan, including, without limiting, the generality of the foregoing: (1) the determination of eligibility for benefits and the amount and certification thereof to the Trustee; (2) the hiring of persons to provide necessary services to the Plan; (3) the issuance of directions to the Trustee to pay any fees, taxes, charges or other costs incidental to the operation and management of the Plan; (4) the preparation and filing of all reports required to be filed with respect to the Plan with any governmental agency; and (5) the compliance with all disclosure requirements imposed by state or federal law.
