Terms of Program. The phased retirement agreement must meet the following terms:

Subject to the terms and conditions of this Agreement, Dealer is authorized to sell Products purchased from XXXXXX to Customers in such manner, at such prices and upon such terms as Dealer shall determine. As further provided in Section 3, Dealer is expressly authorized to pass through XXXXXX’x Products warranty to all Customers for Products sold by Dealer.
Terms of Program. District employees receive retirement benefits through CalPERS. The Retirement Plan between the District and Public Employees Retirement System (PERS) is documented in a separate MOU between CEBU and District entitled “Regarding PERS Retirement Formula Enhancement” dated September 24, 2007 and includes single highest year option and “Local Miscellaneous 2.7% at 55.” Upon submission of enrollment information, CalPERS shall determine whether a new employee is a “classic member” or “new member” in accordance with the Public Employees’ Pension Reform Act (PEPRA). “Classic members” are eligible to participate in the 2.7% @ 55 retirement benefit plan, in accordance with the November 17, 2004 “Regarding PERS Retirement Formula Enhancement” MOU. “New members” are eligible to participate in the 2.0% @ 62 retirement benefit plan and are required to pay CalPERS an employee contribution that is at least fifty percent (50%) of the total normal cost of the retirement benefit plan based on pensionable compensation in accordance with PEPRA.
Terms of Program. The County is only responsible for allowing each non-profit organization to participate in Trash for Cash up to two (2) times per Fiscal Year (July 1-June 30). The Group will remove trash from both sides of the selected roadway (“centerline miles”). The rate per one (1) centerline mile is $100, with the max of $500 earned per cleanup. However, the rate amount is subject to change based on any requirements or regulations from the Kentucky Division of Waste Management. Any changes in rates will be addressed with the Group prior to the execution of this Agreement. The County can only guarantee (1) mile to each group based on the fiscal factors, but is willing to work with the Group to meet its fundraising goals, up to ten (10) centerline miles and $1,000. The Xxxxxxxx County SWC reserves the right to halt the program at any time. If a non-profit organization is notified by the Xxxxxxxx County SWC that their road cleanup is approved, then the project will be funded.

FedEx reserves the right to (a) modify the application period for the Program; (b) alter or modify the Discount, the Program or this Agreement; and,

In the event a Participant is later determined not to be eligible for the Program after being notified that Participant was eligible, Participant's participation in the Program will be terminated. In the event, Participant elects to accept another discount from FedEx after Participant is deemed eligible for the Program, Participant will no longer receive the Discount and Participant's participation in the Program will be terminated. If Participant elects to accept the Discount under this Program, such election will override any other discount. Decisions regarding eligibility to participate in the Program are solely within the discretion of FedEx.

If the product was originally purchased with a credit card, the appropriate amount will be credited back to the original card (or replacement card when necessary). If the product was purchased with a check or with cash, a check will be written to the original purchaser.
