Common use of TERMS AND CONDITIONS OF AGREEMENT Clause in Contracts

TERMS AND CONDITIONS OF AGREEMENT. Postdoctoral Research Associate’s position shall be subject to: (i) the terms and conditions of employment for members of the Other Academic staff as provided in Chapter III of the Bylaws, and (ii) the rights and responsibilities of the professional staff as provided in Chapter IV of the Bylaws. Without limiting the generality of the foregoing sentence, the parties agree that in accordance with the provisions of Chapter IV of the Bylaws, Postdoctoral Research Associate’s agreement may be terminated during the term of this Agreement or any extension thereof for reasons of adequate cause, disability, bona fide discontinuance of the program or department to which the Postdoctoral Research Associate is assigned, or extraordinary circumstances because of financial exigencies. For purposes of this Agreement, adequate cause shall include, but shall not be limited to Postdoctoral Research Associate’s inability to obtain or maintain appropriate immigration documentation.
