Termination for Disability/Death. If Associate Head Coach dies or becomes permanently disabled to the extent that, in the judgment of the Athletics Director, Associate Head Coach cannot satisfactorily perform the duties of Associate Head [Men’s/Women’s] [delete if sport is football] __________ Coach (“Inability to Perform”), this Agreement shall terminate and all obligations of the University to compensate Associate Head Coach pursuant to this Agreement shall cease as of the date of such death or disability. The University shall be obligated to compensate Associate Head Coach or Associate Head Coach’s estate in accordance with this Agreement for services performed prior to the termination date and Associate Head Coach or Associate Head Coach ‘s estate shall be entitled to those benefits, if any, that are payable under any University-sponsored group employee insurance or benefit plan in which Associate Head Coach is or was enrolled.

The term any year of the employment period means any period of twelve (12) consecutive months during the employment period. This Agreement shall, subject to the provisions of Section 1.1, terminate without notice upon the death of the Employee.
Termination for Disability/Death. If Coach dies or becomes permanently disabled to the extent that, in the judgment of the Men’s Athletics Director, Coach cannot satisfactorily perform the duties of Head Football Coach, this Agreement shall terminate on such date for the reason of death or permanent disability and all obligations of the University to compensate Coach pursuant to this Agreement shall cease as of the date of such death or permanent disability, except that the University shall be obligated to compensate Coach or Coach’s estate in accordance with this Agreement only for services performed prior to the date terminated for reasons of permanent disability or death. Coach or Coach’s estate shall be entitled to those benefits, if any, that are payable under any University sponsored group employee insurance or benefit plan in which Coach is or was enrolled on the date this Agreement terminated for reasons of permanent disability or death.

The University shall be obligated to compensate Vice President and Athletics Director or Vice President and Athletics Director’s estate in accordance with this Agreement for services performed prior to the termination date and, Vice President and Athletics Director or Vice President and Athletics Director’s estate shall be entitled to those benefits, if any, that are payable under any University sponsored group employee insurance or benefit plan in which Vice President and Athletics Director is or was enrolled.
Termination for Disability/Death. The Company may terminate the employment of the Employee immediately upon notice to the Employee if the employee becomes permanently disabled, with payment as set out in subsection 3.4; provided however, if such termination would jeopardize the Employee's right to receive long-term disability payments, which he would otherwise receive from the Company's insurers, the Company shall (if so directed by the Employee or his lawful attorney) terminate the employment of the Employee immediately upon cessation of the Employee's entitlement thereto.
