Common use of Tenant’s Parking Clause in Contracts

Tenant’s Parking. In addition, Tenant shall have the right to use in the parking area the Number of Parking Spaces (referred to in Section 1.1) for the parking of automobiles, in common with use by other tenants from time to time of the Complex, provided, Landlord shall not be obligated to furnish stalls or spaces in the parking area specifically designated for Tenant's use. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.6. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6.5. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and except to the extent of any such loss caused by the gross negligence or willful misconduct of Landlord or Landlord’s agents, contractors, or employees. Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

In the event that the Rentable Floor Area of the ComplexPremises decreases or increases at any time during the Lease Term, provided, Landlord the Number of Parking Spaces provided to Tenant hereunder shall not be obligated to furnish stalls or spaces in the parking area specifically designated for Tenant's useadjusted proportionately. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site, subject to the provisions in Section 5.4. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however causedunless caused by the willful acts or negligence of the Landlord or its agents, contractors or representatives, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

In addition, Tenant shall have the right right, at no additional cost to Tenant throughout the Term, to use in the parking area the Number of Parking Spaces (referred to in Section 1.1) for of the parking of automobilesarea, in common with use by other tenants from time to time of the Complex; provided, providedhowever, Landlord shall not be obligated to furnish stalls or spaces in the any parking area specifically designated for Tenant's ’s use. In the event that the Rentable Floor Area of the Premises decreases or increases at any time during the Lease Term, the Number of Parking Spaces provided to Tenant hereunder shall be reduced or increased proportionately. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

Tenant’s Parking. In addition, Landlord shall provide to Tenant shall have the right to use monthly privileges in the parking area the Number of Parking Spaces (referred to number specified in Section 1.1) 1.1 for the parking of automobiles, in common with use by other tenants from time to time of the Complex, providedand on a first-come, first-served basis, at no cost to Tenant and for the duration of the Term (as the same may be extended in accordance with this Lease). Such parking privileges shall be on an unreserved basis in the parking structure located on the Site and the surface parking areas located on the Site (all as shown on Exhibit D-2 attached hereto); provided that at least 50% of such parking privileges shall be located in the parking structure (but Landlord shall not be obligated to furnish reserved stalls or spaces in the parking area specifically designated for Tenant's use’s use within the parking structure). Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.6Article XII below. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

Tenant’s Parking. In addition, Tenant shall have the right to use in the parking area the Number of Parking Spaces (referred to in Section 1.1) for the parking of automobilesautomobiles by its employees and visitors, in common with use by other tenants from time to time of the Complex, provided, however, that Landlord shall not be obligated to furnish stalls or spaces in the any parking area specifically designated for Tenant's ’s use. However, Landlord shall designate five (5) parking spaces for visitor use. Such visitor spaces shall be available to the visitors of all tenants, subtenants and other occupants from time to time of the Building and Landlord shall have no obligation to police or otherwise monitor or regulate the use thereof. Except for payment by Tenant of operating expenses as provided in Section 2.6 hereof, there shall be no charge for Tenant’s use of such parking spaces during the Original Term. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6.5. Further, except for the negligence or willful misconduct of Landlord and persons for whose Landlord is responsible, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

In addition, Tenant shall have the right right, free of charge during the Original Term of this Lease, to use in the parking area the Number of Parking Spaces (referred to in Section 1.1, which such Number of Parking Spaces shall be increased proportionately to reflect any increases in the Rentable Floor Area of the Premises) for the parking of automobiles, in common with use by other tenants from time to time of the Complex, provided, however, that Landlord shall not be obligated to furnish stalls or spaces in on the parking area Site specifically designated for Tenant's use. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations of general application promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6.5. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however causedcaused (except to the extent caused by the negligence or willful misconduct of Landlord or its agents, employees or contractors), and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

Tenant’s Parking. In addition, Tenant shall have the right to use in the parking area area, without charge during the Original Term (except as set forth in Section 2.6 below), twenty-four (24) hours per day, seven (7) days per week, the Number of Parking Spaces (referred to in Section 1.1) for the parking of automobiles, in common with use by other tenants from time to time of the Complex, provided, however, that Landlord shall not be obligated to furnish stalls or spaces in on the parking area Site specifically designated for Tenant's use. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord and made known to Tenant with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6.5. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, unless caused by the gross negligence or willful misconduct of Landlord, its agents, servants or employees, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability. Tenant acknowledges and agrees that a license only is hereby granted, and no bailment is intended or shall be created.

In addition, Tenant shall have the right to use in the parking area area, at no additional charge, the Number of Parking Spaces (referred to in Section 1.1) for the parking of automobiles, in common with use by other tenants from time to time of the ComplexProperty, provided, however, that Landlord shall not be obligated to furnish stalls or spaces in on the parking area Site specifically designated for Tenant's ’s use. In the event that the Rentable Floor Area of the Premises increases or decreases at any time during the Lease Term, the Number of Parking Spaces provided to Tenant hereunder shall be increased or reduced proportionately. Tenant covenants and agrees that it and all persons claiming by, through and under it, shall at all times abide by all reasonable rules and regulations promulgated by Landlord with respect to the use of the parking areas on the Site. The parking privileges granted herein are nontransferable non-transferable except to a permitted assignee or subtenant as provided in Section 5.6 through Section 5.6.65.6. Further, Landlord assumes no responsibility whatsoever for loss or damage due to fire, theft or otherwise to any automobile(s) parked on the Site or to any personal property therein, however caused, and Tenant covenants and agrees, upon request from Landlord from time to time, to notify its officers, employees, agents and invitees of such limitation of liability.
