6289]}], "snippet": "7.1 The School District recognizes that appropriate texts, maps, laboratory equipment, audio- visual equipment, art supplies, athletic equipment, standardized tests and questionnaires, safety equipment, and similar materials are the tools of the teaching profession. The principals and their staffs shall confer at least once a year for the purpose of improving the selection and use of such educational tools. The School District shall continue to keep the schools reasonably and properly equipped and maintained insofar as financially feasible.\n7.2 Teachers shall have the use of available computers and all duplicating and copying equipment in the building for preparation of instructional material. All damaged and malfunctioning equipment shall be reported to the building Administrator immediately for proper maintenance and repair.\n7.3 The School District shall make available in each school at least one room, cleaned daily, appropriately furnished, which shall be reserved for the use as a faculty lounge. A refrigerator and microwave may be installed for the use of the teachers at no expense to the School District, and it will be the responsibility of the Union to keep this equipment clean. A work table or desk and an available computer shall be provided in either the faculty lounge or other work room provided in the building. The furnishings shall be cleaned, repaired yearly, and replaced if necessary.\n7.4 Telephone facilities at SACE shall be made available to teachers for their reasonable use for transaction of school business. A direct line shall be available in the SACE teacher's lounge for teachers\u2019 exclusive use. All calls shall be recorded on the forms provided with the teacher's name, number called, and date of call. The forms will be located next to the phone.\n7.5 The School District will continue to provide off-street parking facilities where they now exist, adequately maintained, for teachers use.\n7.6 The School District will provide for each teacher a desk, storage, and access to a working computer, printer, and current grading software.\n7.7 The School District shall provide for machine scoring of tests of a standardized nature (reading, IQ, achievement, aptitude) when feasible from the standpoint of the number of students being tested.\n7.8 Teachers shall not be required to do major repair work or replacement work on property and equipment.\n7.9 The School District and the Union mutually recognize the importance of continuous use of adequate teaching reference material in maintaining a high level of professional performance. In furtherance of that recognition, the School District shall provide within financial means a teacher reference area in each school.\n7.10 Announcement of all professional workshops and conferences shall be posted on the bulletin board in the teacher lounge when received.\n7.11 In the case of future annexation and/or consolidation, all teachers shall come into the School District with tenure status provided for in Michigan\u2019s Teacher Tenure Act.\n7.12 Whenever possible, teachers with laboratory preparation will have access to the facilities of their rooms. The final determination will be made by the Director.\n7.13 Recognizing the importance of School-Community relations, teachers are expected to help plan, attend and participate in parent-teacher meetings, open houses, school programs, and activities as part of their professional responsibility and commitment to school improvement.\n7.14 School rooms will be used for school functions first rather than released for other purposes. No rooms used for other purposes shall be allowed to disturb or disrupt in any way rooms used for classes in session.\n7.15 Teachers may be required to sign in at the time of arrival at the building and may be required to sign out at the time of departure. Teachers will also sign out for all field trips and will sign out when taking students out of the building.\n7.16 A teacher who performs substitute duties will be compensated at the teacher\u2019s hourly rate of pay.\n7.17 A teacher engaged during the school day in any professional grievance hearings, including arbitration, shall be released from regular duties without loss of salary or accrued days for that time.\n7.18 No student shall have access to teachers' keys. Teachers shall immediately report any lost keys to their Building Principal or Supervisor.\n7.19 Scheduling of all weekend or holiday use of a building by a teacher or coach shall be in conformance with existing School District policy.\n7.20 Teachers and children will be relocated within the building by the Principal or relocated/sent home by the Principal with the approval of the Superintendent when room temperature, ventilation, or other condition becomes incompatible with health and/or safety.\n7.21 Every effort will be made to have all computer labs opened and staffed during the school hours each day, subject to available finances.\n7.22 The creation and preservation of a safe, healthful, quiet, and comfortable classroom and general school facilities are necessary for the best interests of the children, the teachers and the furtherance of the educational process. Should the Union feel the above are inadequate or inadequately maintained, notice shall be given to the Building Principal for review.\n7.23 Both teachers and the School District recognize the need for trust and cooperation in order to deal with school improvement activities. The process of site-based decision making and school improvement will be a cooperative effort using problem solving and a win-win philosophy. It is agreed that the basis for decisions will be the underlying standard, \"What is best for students,\" and that the participation of teachers, administrators, parents, and other community members is necessary to become an exemplary school district and to meet the goals of the District's mission statement. A School Improvement committee may not modify the Master Agreement in whole or in part except by mutual written agreement by the Union and the Board.\n7.24 Teachers shall not smoke on school property.\n7.25 Teacher Professional Development. Each teacher shall spend thirty (30) hours during a weekday annually in professional development activities, excluding weekends unless otherwise mutually agreed.", "hash": The provisions of this Section A. shall be subject to reasonable exceptions and deviations during the first three (3) weeks of each semester or other enrollment term. It is also recognized that other exceptions may be desirable whenever it is necessary to work with larger numbers of students, such as for example, in physical education, band, choir and orchestra with respect to which the student-teacher load may be adjusted to the size that can be accommodated in the school facilities. This adjustment shall have particular emphasis with respect to physical education classes where all reasonable steps shall be taken by the Board of Education to equally distribute students among the various sections of the course.\n2. Should any individual class in grades Young 5\u2019s exceed twenty (20), K exceed twenty-four (24), Grades 1-2 exceed twenty-seven (27), and in Grades 3-5 thirty (30), as well as the average of 30 in Grades 6-12 (i.e. max of 150 at MS and 120 at HS while on trimesters), the Board shall immediately take all reasonable steps to correct the problem, including the possibility of a different class location of students, the hiring of additional teachers, or any other mutually acceptable solution. In the event that none of the above steps are implemented to correct the problem and the Board determines that it is necessary to exceed the above maximum class size limits, the following compensation formula shall be instituted: salary schedule amount 1 # of students membership X # of school X in excess of X days in Applicable class days on school maximum class size limit calendar class limits\n3. Any individual with a disability, IEPC identified as emotionally impaired, mainstreamed into a regular education classroom shall be counted as two (2) students for the purpose of this Article. If such mainstreaming results in a class enrollment that violates provisions of this Article the Board will:\na. reduce the enrollment to the contractual limit, or b. provide a remedy which is acceptable to the teacher in question and the Association.\n4. Teachers shall attend and participate in IEP and 504 meetings as legally required. The definition of an IEP meeting includes any team meeting(s) prior to or following the actual IEP meeting. Each of those meetings would be considered separate meetings if necessary for one student and occur at different times and/or dates. A 504 meeting is also considered for compensation under this section of the contract. In addition, any teacher whose referral results in an IEP shall have the option of attending and participating in the IEP. When an IEP is going to consider mainstreaming an identified student with a disability, the regular education elementary teacher or one (1) regular education secondary teacher, such as the case may be, shall have the option of attending and participating in the IEP.\n5. A classroom teacher or special education teacher, who fittingly attends and participates in more than four (4) IEPs or 504 meetings held before or after regular school hours during a school year, shall be paid $25.00 for each IEP after the fourth.\nB. To the extent practicable, the Board will make available to teachers in each school building adequate lunchroom, restroom, and lavatory facilities, and at least one room, appropriately furnished, which shall be reserved for use as a faculty lounge.\nC. Teachers shall be permitted to place outgoing non-toll calls on the office telephones in their building, but it is expected that personal, non-emergency calls will be held to a minimum. Teachers will be given \u201cto call\u201d messages on incoming calls, to be returned by the teacher outside of classroom hours, but will be given immediate opportunity to return calls relating to grave emergencies, such as death or serious illness or injury of a close relative.\nD. To the extent practicable, parking facilities shall be made available to teachers within a designated area. The Board assumes no new additional liability respecting parking facilities or their use by teachers as a result of any provision of this Agreement and that parking will be the teacher\u2019s own risk Where physical facilities allow, without impinging on instructional areas, the Board will make available one furnished room vented by window or fan, which shall be reserved as a faculty lounge. When new schools are constructed or when existing schools are renovated, at least one faculty lounge shall be included.\nB. Where physical facilities allow, the Board will make men\u2019s and ladies\u2019 restroom facilities available for the exclusive use of staff personnel. When new schools are constructed, these facilities will be included. Where requested, the Board shall investigate the conditions of restroom facilities and where they are found to be inadequate, initiate plans to remedy the situation.\nC. The Board shall make available a telephone in each school for teachers to use and privacy assured when requested. When new buildings are built, or existing buildings are substantially renovated, telephones shall be installed in each classroom.\nD. When facilities allow, off-street parking shall be provided and identified as restricted for the use of all employees of the School District. The maintenance of these facilities shall include systematic snow removal and the District shall make a good faith effort to remove snow prior to the opening of school.\nE. All announcements shall be made prior to the commencement of the first period or at the end of the last period of the day or before the departure of students for first lunch period except in cases of emergency.\nF. Teachers will have free access to appropriate duplicating and typing equipment to aid them in the preparation of instructional materials.\nG. The principle responsibility for maintaining discipline remains with the teacher. It is recognized, however, that there are times when teachers will have to make use of special disciplinary procedures. In this connection disruptive students may be removed from the regular classroom or school when, in the professional judgment of the teacher, normal corrective measures have been ineffective in bringing about satisfactory improvement. Such student shall be reported to the Principal and he/she may take whatever action that he/she deems necessary except that he/ she may not return the student to the classroom of the same teacher, or retain the student in school without the teacher\u2019s approval. If this disruptive student is assigned to the regular classroom of another teacher, this teacher shall be apprised of the conditions and circumstances which led to that student\u2019s removal. He, too, has the right to refuse to accept the disruptive student in his classroom. If this disruptive student is assigned to another school, the teacher committee of the receiving school shall be apprised of the conditions and circumstances which led to that student\u2019s removal. They, too, have the right to refuse the acceptance of the student in their school. If the principal or any other administrator feels that the disruptive student should be considered for return to the regular classroom or school against the wishes of the teacher, a committee of three (3) teachers from the building selected by the teachers in that building shall meet and decide whether or not the student should be returned to the regular classroom or permitted to attend school. This committee shall utilize school specialists and the principal, if needed, to help formulate their decision. The decision of this committee shall be limited only to the question of whether or not the student should be returned to the regular classroom or permitted to attend the same school. If the student is not returned to the regular classroom or school, he/she shall be returned to the principal for further action. If, at a later day, it appears that this student should be returned to his regular class or school, the Board shall refer the matter back to the committee for approval. Incorporated herein and made a part hereof by reference is the Consent Decree entered in the United States District Court for the Western District of Pennsylvania, Civil Action No. 34-75 Erie, signed by the \u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2587 \u2587\u2587\u2587\u2587\u2587\u2587\u2587 \u2587. Knox, Judge, on February 5, 1974, which decree sets forth the procedures to be followed in connection with the subject matter set forth in this subparagraph. Further incorporated herein and made a part hereof by reference is the Decree entered in the same Court June 7, 1977, as expanded, changed or modified in the Memorandum of said Court dated June 27, 1977, as expanded, changed or modified by the opinion of the United States Court of Appeals for the Third Circuit, No. 77-2137 and No. 77-2138, dated August 21, 1978, as expanded, changed or modified by subsequent final court order.\nH. All teachers shall have available for their use a desk in the classroom or teaching area. In the event more than one teacher shall use the same classroom or teaching area at different times, such desk shall be shared. In addition, the District shall provide at least one of the following for each teacher: a filing cabinet or a locker or a closet which can be locked.\nI. Each teacher shall have for his own use a copy of each student text and, if available from the publisher of the student text, a teacher\u2019s manual or annotated text for each course he/she teaches.\nJ. Teachers shall not act as substitutes for principals in the building to which they are assigned.\nK. Upon the request of the Association, vending machines shall be installed in teacher lounges if no additional expense is incurred for installation by the School District. Teachers shall determine the distribution of the proceeds of such machines. The Board shall assume no responsibility for liability, loss, or damage from the installation and use of such machines or their proceeds.\nL. The Board agrees that custodial, maintenance or secretarial personnel shall not be delegated supervisory authority over teachers or other professional staff personnel in a school.\nM. Teachers will have at least five (5) planning and/or preparation periods per week which shall be a minimum of forty (40) minutes each during the regularly scheduled day. A preparation period shall be defined as that period during which the teacher shall perform those activities that he/she shall determine necessary to conduct his classes. Such periods can be used for faculty meetings as described in Article V-I. Homeroom teachers in elementary buildings may use one related arts period per week as a preparation period to compensate for the time being lost during dismissal procedures.\nN. Consideration will be given to new and probationary teachers in making assignments, recognizing their lack of experience.\nO. Reassignment of probationary teachers to substantially different grade levels in the elementary schools or different subjects in the secondary schools shall be avoided, unless the probationary teacher agrees to such a change.\nP. No teacher shall be assigned outside of the scope of his current teaching certificate.\nQ. It is the position of the Board that split grades in the elementary schools should be phased out. Such classes shall not exceed twenty-five (25) students. The above shall not apply to non-graded or team teaching situations or departmentalized instructional programs, i.e., music, physical education, etc. Students in a split class shall be screened in a timely fashion for instructional compatibility by the Principal and teachers subject to final determination by the Principal.\nR. To help relieve classroom teachers of duties which do not require certification, including but not limited to cafeteria patrol, playground, bus, and study hall duty, the Board agrees to engage not less than one aide per school for this purpose.\nS. In instances where the Association identifies a condition where storage facilities or equipment are considered to be inadequate in the normal discharge of a teacher\u2019s responsibility, it shall notify the Board in writing who shall investigate the condition. Where the storage facilities or equipment are found to be inadequate, the conditions will be rectified promptly.\nT. The Board shall provide adequate supplies for the normal discharge of teaching responsibilities.\nU. Teachers may request their immediate superior to requisition particular teaching reference material which they feel is necessary to carry out their individual classroom responsibility.\nV. A teacher shall not be required to accept additional children into his regular classroom because a substitute teacher was not provided, except in case of emergency.\nW. In instances where a teacher identifies a situation which he/she thinks is unsafe or unhealthy for pupils and teachers, he/she shall notify the principal. The principal shall investigate the condition with the teacher. He/she shall take immediate steps to rectify the situation, which may require vacating the school or an area thereof.\nX. Expendable teaching supplies will be requisitioned as needed for night school and will not be provided from regular program supplies. Y. l) Any complaints by parents of a student or by members of the community that are directed toward a teacher and are to become a matter of record shall be called to the teacher\u2019s attention It is also acknowledged that the primary duty and responsibility of the teacher is to teach and that the organization of the school and the school day should be directed at insuring that the energy of the teacher is primarily utilized to this end.\nA. When a teacher is burdened with conditions that are contrary to the above intent in terms of class size or school facilities, said teacher should call the matter to the attention of the Building Principal. If the matter cannot be remedied by the Principal, the teacher, the Association and Principal shall meet with the Superintendent with the idea of affecting a remedy.\nB. The Superintendent or his designee will meet with representatives from the Association to review class size on a district-wide basis. The initial meeting to review secondary class sizes will be held no later than the fifth (5th) day of each quarter if applicable. The initial meetings to review elementary class sizes shall be held within five (5) days of the fourth Friday of the school year and within five (5) days of the end of the first semester.\nC. The Board shall, whenever possible, make available in each school adequate lunchroom, restroom, and lavatory facilities primarily for faculty use and at least one (1) furnished room which shall be reserved for use as a faculty lounge.\nD. Telephone facilities shall be made available to teachers for their reasonable use.\nE. Teachers shall report unsafe working conditions to the Administration; if the Administration concurs, appropriate steps shall be taken to remedy the situation.\nF. Thirty (30) hours shall be set aside for Professional Development and twelve (12) hours for parent- teacher conferences. New teachers shall be given an additional day for special orientation. These days will be identified in the mutually developed district calendar.\nG. When a school is dismissed early because of weather conditions, the teachers of that school may leave as soon as it is reasonably sure that the students will arrive home.\nH. Supervisory teachers of student teachers shall be tenured teachers who voluntarily accept the assignment. The parties recognize that \"supervisory teachers\" are not supervisory teachers under Public Act 379 of 1965.\nI. Teachers will receive their regular pay for days that are canceled but shall work on any rescheduled days with no additional compensation.\n1. If at any time during the life of this Agreement, it becomes lawful to count (for the purpose of state member aid) as days of pupil instruction days when pupil instruction is not provided due to conditions not within the control of school authorities due to severe storms, fires, epidemics, or health conditions, it is agreed that the following provision shall become immediately in effect:\n2. There shall be one thousand ninety-eight (1,098) hours (not to exceed one hundred eighty (180) days) of student instruction and one hundred eightyfour (184)-teacher attendance days. Act of God days shall be included in instruction days. If a school is closed to students for construction, transportation, or health problems, teachers need not report.\n3. (Scheduled days of student instruction which are not held because of conditions not within the control of school authorities such as inclement weather, fires, epidemics, mechanical breakdowns, or health conditions as defined by the city, county or state health authorities, may be rescheduled at the discretion of the Board of Education to ensure that there are a minimum of one thousand ninety-eight student instructional hours.).\nJ. On Act of God days no teacher will be charged personal business or sick days and shall suffer no loss of pay.\nK. Both parties mutually agree that they share as a primary objective the enhancement of student learning in the classroom. Both parties recognize that variety of factors interact in numerous ways to influence optimal student learning in the classroom. Both parties recognize that one factor, optimal class size, is desirable as it contributes to the quality of instruction and learning which is a mutual goal. With this in mind, both parties agree that:\n1. Class size for kindergarten will be twenty five (25) students. If the average kindergarten class exceeds twenty four (24) on the first day of class, then a meeting will be held between administration and teachers within three days to attempt to remedy the situation. Class size for grades 1-3 will be twenty-eight (28) students or less. Class size for grades 4-6 will be thirty (30) students or less. Within two (2) weeks of the beginning of the school year all classes will be within these limits or will have a maximum of no more than two (2) higher. Cross leveling of classes will be attempted to equalize class loads across the district.\n2. Class sizes for grades 7-12 in excess of thirty-two (32) are not desirable, and the parties mutually agree to work toward maintaining class size below these levels. Both parties, however, recognize that the attainment of such optimal conditions is largely dependent upon the financial resources available to the District. The parties further agree that traditionally large and small classes may be exempt from the optimal size. Special students with mental, emotional, or physical handicaps will be considered as extra teaching responsibility when assigned to a regular classroom. When such assignments are anticipated, the beginning class size will be set at less than the maximum contract limit; (i.e., K - 3 = 30; 4 - 6 = 32) in order to allow for them. Students who move in after the September count day shall not be counted for purposes of this language. When an overload arises and is brought to the attention of the Building Principal, a remedy shall be agreed upon or a remedy shall be affected by the Superintendent and the Association. The remedy may include, but is not limited to the reassignment of students, provision for teacher assistance, and provision for additional pay.\nL. It is also acknowledged that the primary duty and responsibility of the teacher is to teach, and that the organization of the school and the school day should be directed at ensuring that the energy of the teacher is primarily utilized to this end.\nB. Because the pupil-teacher ratio is an important aspect of an effective education program, the parties agree that class size should be reduced wherever possible.\nC. The Board recognizes that appropriate texts, library reference facilities, maps and globes, computers, laboratory tools and equipment, audio-visual equipment, art supplies, athletic equipment, current periodicals, standard tests and questionnaires and similar materials are the tools of the teaching profession. The teachers and administration will meet from time to time for selection and improvement of teaching tools.\nD. The Board and Association mutually recognize the importance of continuous use of adequate teaching reference material in maintaining a high level of professional performance in furtherance of that recognition, the Board will attempt to provide a teacher reference library in each school in the District and include therein all text which are reasonably requested by the teachers of that school. The Board shall provide memberships in appropriate curricular and professional organizations and societies. The IPPC shall determine the appropriate memberships, but shall be limited to a total of fifteen (15) memberships.\nE. The Board agrees to make available in each school, typing and duplicating facilities to aid teachers in the preparation of instructional materials.\nF. The Board will attempt to provide:\n1. A separate desk for each teacher in the District with a lockable drawer space.\n2. Suitable closet space for each teacher to store coats, overshoes and personal articles. Other suitable space may be substituted for closet space, if approved by the teacher.\n3. Adequate chalkboard/whiteboard space in every classroom.\n4. Copies, exclusively for each teacher's use, of all text used in each of the courses he/she is to teach.\n5. An appropriate dictionary in every classroom, when requested by the teacher.\n6. Adequate storage space in each classroom for instructional materials.\n7. Adequate attendance books, paper, pencils, pens, chalk, dry erase markers, erasers, computers and other materials required in daily teaching responsibility.\n8. Shop coats for art, home economic, vocational and industrial education teachers.\nG. To relieve teachers of clerical, patrol and bus duty, the Board agrees to employ support staff. The support staff will be responsible to the building principals to whom they are assigned and will handle patrol duties, inventorying of supplies and equipment, duplication of teaching materials, collecting monies for milk and lunch, and similar support responsibilities.\nH. The Board shall make available in each school adequate rest rooms and lavatory facilities exclusively for staff use and at least one room, appropriately furnished, which shall be reserved for the use of the staff as a lounge.\nI. The Board shall provide a telephone in the teachers' lounge in each building for teacher use. These telephones shall be listed in the name of the GEA and the Board shall reimburse the GEA for the regularly monthly service charge excluding all long distance toll charge.\nJ. Vending machines shall be installed in lounge areas, at the request of the Association. The proceeds are to be used for the respective GEA Building Lounge Funds. There will be no cost to the Board of Education.\nK. Adequate off-street parking facilities shall be provided, and properly maintained.\nL. Teachers shall not be required to work under unsafe or hazardous conditions or to perform tasks which endanger their health and well-being.\nM. Under no conditions shall a teacher be required to drive a school bus as part of his/her regular assignment.\nN.
