TEACHERS' RIGHTS AND RESPONSIBILITIES. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every member of the Association shall have the right to organize, join, and support the Association for the purpose of engaging in collective bargaining and negotiations, or to refrain from such activities.
TEACHERS' RIGHTS AND RESPONSIBILITIES. A. Statutory Rights. Pursuant to the Michigan Public Employment Relations Act, MCL 423.211et seq. as amended, the Board agrees that every teacher employed by the Board shall have the right to freely organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiations or other legally permissible concerted activities for mutual aid and protection, or to refrain therefrom as provided by law. The Board and the Association agree that neither will, directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by the Michigan Public Employment Relations Act, MCL 423.211 et seq. or the laws of Michigan and the Constitution of Michigan and the United States, discriminate against any teacher with respect to wages, hours, and other terms and conditions of employment by reason of the teacher's membership or non-membership in the Association, the teacher's participation in any activities of the Association, collective professional negotiations with the Board, the teacher's institution of any grievance, complaint or proceeding pursuant to this Agreement, or otherwise to any terms and conditions of employment.

A teacher shall be entitled to have present a representative of the Association during any disciplinary action when such action will become part of the teacher's personnel file. Such time shall be at least 30 consecutive minutes, unless mutually agreed upon between the building principal/administrator and teacher involved. It is understood that occasional meetings with administrators, colleagues, or parents may take place during this time. Meetings of a routine nature (i.e. daily or weekly grade level team meetings) shall not be scheduled during preparation time unless all parties involved agree to meet. Each secondary teacher shall be assigned no less than one (1) class period for lesson preparation.
