TANK CARS. 6.1 If tank cars owned or leased by Seller are used to deliver Product hereunder and they are not unloaded and returned to the railroad within one Day of being Constructively or Actually Placed, Buyer shall be liable to Seller for rental at the rate of (i) $75.00 for each Day (or fraction thereof) in excess of five Days; (ii) the then applicable third party lease rate for tank cars on the spot market in the vicinity of the delivery point for the Product; or

TANK CARS. If tank cars owned or leased by Seller are used to deliver Product hereunder and they are not unloaded and returned to the railroad within five (5) days of arrival, Purchaser shall be liable to Seller for rental at the rate of (i) $150.00 for each day (or fraction thereof) in excess of five (5) days. Tank cars shall not be diverted without Seller's prior written consent.
TANK CARS. Buyer will be responsible for providing a minimum of [***] needed for rail transportation and will manage Seller’s Tank Car fleet. Buyer will lease [***] per Tank Car per month. TANK CARS. 15.1. If delivery is made in Delivering Party’s tank cars, Receiving Party agrees to promptly accept such cars upon arrival at destination and notification of readiness from the delivering carrier. Receiving Party agrees to unload such tank cars within five days of arrival at destination and promptly return such cars via the routing specified by the Delivering Party.

  • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.

  • Transportation Services i) In the event that transportation services for a student served by CONTRACTOR pursuant to an Individual Services Agreement are to be provided by a party other than CONTRACTOR or the LEA or its transportation providers, such services shall be reflected in a separate agreement signed by the parties hereto, and provided to the LEA and SELPA Director by the CONTRACTOR. Except as provided below, CONTRACTOR shall compensate the transportation provider directly for such services, and shall charge the LEA for such services at the actual and reasonable rates billed by the transportation provider, plus a ten percent (.10) administrative fee, unless a “flat rate” is provided in the transportation contract. In the event that the transportation provider notifies the LEA or SELPA Director that CONTRACTOR is more than 90 days behind in payment for transportation services, LEA shall have the right, in its sole and exclusive discretion, but not the obligation, to make payment for such services directly to the transportation provider, and to deduct such payments from any sums owed to CONTRACTOR pursuant to this Master Contract and any Individual Services Agreement between the parties. In the event that the LEA makes direct payment of the transportation provider’s charges, it shall be entitled to withhold both the transportation charges themselves and such additional amount as shall be reasonably necessary to compensate the LEA for the staff and other costs incurred in making direct payment of those charges. The remedies provided to the LEA pursuant to this Paragraph shall not be exclusive. CONTRACTOR shall not include transportation through the use of services or equipment owned, leased or contracted through the LEA unless expressly provided in the Individual Services Agreement for the student transported.

  • Two-Way Interconnection Trunks 2.4.1 Where the Parties have agreed to use Two-Way Interconnection Trunks for the exchange of traffic between Verizon and ICG, ICG shall order from Verizon, and Verizon shall provide, the Two-Way Interconnection Trunks, and the Entrance Facility on which such Trunks will ride, and transport and multiplexing, in accordance with the rates, terms and conditions set forth in this Agreement and Verizon’s applicable Tariffs.
