Surrender at Expiration. Upon expiration or other termination of this Lease, Tenant shall immediately surrender possession of the Premises to Landlord in substantially the condition in which Tenant is required to maintain the Premises except for reasonable wear and tear (and damage by fire or casualty if not the result of fault or negligence of Tenant, its agents, employees or invitees).

Surrender at Expiration. Upon the expiration of the term of this lease or in the event of termination by reason of casualty or condemnation, the Tenant shall quit and surrender the demised premises, together with any fixtures, equipment or appurtenances installed in the premises at the commencement of this lease, and any alterations, decorations, additions and improvements which are not to be removed in compliance with the provisions of Article FOURTH hereof, to the Landlord, broom clean, in good order and condition, ordinary wear excepted. If the last day of the term of this lease falls on Sunday, this lease shall expire on the business day immediately preceding. The Tenant's obligation to observe and perform this covenant shall survive the expiration or other termination of the term of this lease.
Surrender at Expiration. Conditions of Premises: Upon expiration of the Lease term or earlier termination on account of default, Tenant shall deliver all keys to the Landlord and surrender the leased premises in first-class condition and broom-clean. Tenant has deposited with Landlord the sum of $-0- as a security deposit. Landlord shall have the right to deduct all expenses of cleaning the premises from such deposit and repair any damage other than normal wear and tear. Alterations constructed by Tenant with permission from the Landlord shall not be removed or restored to the original condition unless the terms of permission for the alterations so require. Depreciation and wear from ordinary use for the purpose for which the premises were let need not be restored, but all repair for which the Tenant is responsible shall be completed to the latest practical date prior to such surrender. The Tenant's obligations under this paragraph shall be subordinate to the provisions of Section 7 related to destruction. Fixtures: (a) All existing fixtures upon the leased premises during the term, other than Tenant's trade fixtures, shall be the property of the Landlord. (b) All fixtures and personal property brought onto the property shall remain the property of the tenant. Holdover: (a) If the Tenant does not vacate the leased premises at the time required, the Landlord shall treat the Tenant as a tenant from month to month. Nonwaiver: Waiver by either party of strict performance of any provision of this lease shall not be a waiver of or prejudice the party's right to require strict performance of the same provision in the future or of any other provision. Sign Approval: Landlord retains the right to approve any sign placed on the premises. Any sign that Tenant has the right to place, construct and maintain shall comply with all laws, and Tenant shall obtain any approval required by such laws. Tenant to pay all costs for signage.

Surrender at Expiration. On the last day of the Term hereof or upon any earlier termination of this Lease, or upon a re-entry by Landlord upon the Property pursuant to Article 16 hereof, Tenant shall surrender and deliver to Landlord the Property and any improvements then existing on the Property free and clear of all lettings and occupancies other than subleases then terminable at the option of Landlord or subleases to which Landlord shall have specifically consented, in good order, repair and condition, and free and clear of all liens and encumbrances other than those, if any, existing at the date hereof or created by Landlord, without any payment or allowance whatever by Landlord. Landlord and Tenant each hereby waives any notice now or hereafter required by law with respect to vacating the Property on any such termination date. Nothing in this Lease is intended as, nor shall it be construed to, require Tenant to undertake or bear the cost of any remedial or cleanup actions arising out or related to the presence of any Hazardous Materials at the Premises due to the continued terminal operations of Landlord or arising out of or related to any Pre-Existing Conditions, other than remedial work for which Tenant is expressly responsible as set forth in Article 21.
