Supply Period. For the duration of the Assigned Supply Period, IDT will utilize the Assigned Systems to manufacture and sell Program Oligonucleotides ordered by ISIS according to the terms and conditions as described in this Agreement. This commitment by IDT includes the obligations of IDT to individually staff, train, and fully compensate, the personnel needed to operate the Assigned Systems for ISIS, and to otherwise fully manage the production and delivery of Program Oligonucleotides to ISIS.
Supply Period. The following provisions apply to the way the term of this agreement is extended, the identification of each Supply Period during that ongoing term and the manner in which Norco or the Supplier can elect not to extend the agreement.
Supply Period. (a) The Supply Period for a Site commences on:
(i) if the Buyer is an existing customer of Change Energy, the start of the next Billing Period immediately after the Contract Start Date;
(ii) if the Buyer is not an existing customer of Change Energy, the last to occur of the following, as applicable:
A. the date the Meter for the Site is energised;
B. the date the Meter for the site is replaced or reconfigured; and
C. the date the transfer request transferring the Site from another electricity retailer to Change Energy becomes effective.
(b) Unless otherwise agreed in writing by the Parties, Change Energy may terminate this Agreement if, by the date which is 30 days after the Contract Start Date, no Supply Period for any Site has commenced under clause 1.5(a).
(c) This Agreement ends on the Contract End Date, unless terminated earlier in accordance with this Agreement.
Supply Period. (a) The supply of Power under this Agreement shall (i) commence on the Supply Period Commencement Date and (ii) cease on the Supply Termination Date (the Supply Period).
(b) The date of commencement of the Supply Period shall be the earlier of (i) [duration determined by the Parties] after the beginning of the Testing Period, provided that the condition specified in Clause 2.2(a)(ii) is still fulfilled and (ii) the date notified by the Producer to the Buyer (the Supply Period Commencement Date). Such notice shall be served by email with return receipt or registered letter with acknowledgement of receipt, substantially in the form attached in Annex°2 thereto, at least [duration to be determined by the Parties] Business Days prior to the Supply Period Commencement Date. The Parties agree that the Supply Period Commencement Date shall be the first day of the month following the date on which the aforementioned notice is served.
(c) The Supply Period shall cease on the date provided for in Clause 2.5 or on the date on which this Agreement is terminated pursuant to Clause 13 (the Supply Termination Date).
Supply Period. 5.1 The supply period for NG shall begin on the Commissioning Start Date and shall continue in force until and including the last Day of the Contract Term (the "Supply Period").
5.2 The phase of the Supply Period from, and including, the Commissioning Start Date to, and including, the fmal Day of the calendar month in which the Firm Supply Conditions Date occurs shall be considered to be a transitional supply period (the "Transitional Supply Period").
5.3 The phase of the Supply Period from and including the first Day of the first calendar month that commences after the Firm Supply Conditions Date to and including the last Day of the Contract Term shall be the "Firm Supply Period."
5.4 Seller shall use commercially reasonable efforts to complete those elements of the Works that are necessary to make the Interconnection Facility and SJ 6 capable of receiving and using Natural Gas (the "SJ 6 First Gas Requirements") for commissioning on a Day (the "Commissioning Start Date") that occurs on or before the Guaranteed First Gas Date (as it may be extended pursuant to this Clause 5.4). Seller shall deliver written notice to Buyer promptly upon achievement of the SJ 6 First Gas Requirements and the Commissioning Start Date. If, due to events or circumstances not attributable to Seller (including (i) any event of Force Majeure, (ii) any material breach of this Agreement by Buyer (including of Clause 3.5), (iii) any variance from the assumptions specified in Clause 3_5 with respect to Puerto Rican Governmental Authorities, (iv) any act or omission of MHPSA, including failure to perform any part of the Works fully in accordance with the terms of the agreement between MHPSA and Seller, or any delay in performing such work, (v) any act or omission of Buyer, including Buyer's inability, for any reason, to satisfy the Buyer Firm Supply Condition, and (vi) any Change of Law), satisfaction of the SJ 6 First Gas Requirements is delayed, the Guaranteed First Gas Date shall be automatically extended by the number of days by which such events or circumstances directly or indirectly delay satisfaction of the SJ 6 First Gas Requirements.
5.5 If the Commissioning Start Date fails to occur within seven (7) calendar Days after the Guaranteed First Gas Date, Seller shall be liable to Buyer for delay liquidated damages of Three Hundred Thirty -Three Thousand Three Hundred Thirty Three Dollars and 33/100 Cents ($333,333.33) per Day that elapses between the Day that is the eighth (8th)...
Supply Period. Where Deliverables are Services and those Services are to be provided to the Customer over the Supply Period specified in the Customer Order, the Contractor must provide the Services during that Supply Period at the Delivery Point.

For purposes of this Agreement, "ready for commercial operation" shall mean that Products are available for supply to Buyer from the Facility at substantially the quantities and specifications set forth herein. Notwithstanding anything to the contrary in this Agreement or the Letter Agreement described below, any activities or obligations related to the Facility will be conducted under and in accordance with the Letter Agreement dated 7 July 1998 (as amended) between Seller and Buyer (including the obligation to pay termination payments and cancellation charges) and the Interim Lease until such time as Port Arthur completes financial closing under the Financing Docume▇▇▇, ▇hich will occur on or before 15 August 1999. In the event financial closing does not occur as described, the provisions of the Letter Agreement shall continue to apply notwithstanding anything in the Letter Agreement to the contrary. Buyer shall provide written notice of financial closing to Seller. Upon such notice to Seller, the terms and conditions in this Agreement shall take effect (other than the last four sentences in this Section 2.1 which take effect now).
