Common use of Summary Dismissal Clause in Contracts

Summary Dismissal. Notwithstanding the provisions of Clause 28.1.1 hereof, the employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases the wages shall be paid up to the time of dismissal only.

Summary Dismissal. Notwithstanding the provisions of Clause 28.1.1 hereof, clause 34.1(a) hereof the employer Employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases the wages shall be paid up to the time of dismissal only.

Summary Dismissal. 14.5.1 Notwithstanding the provisions of Clause 28.1.1 hereof, subclause 14.1 the employer Employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, including malingeringbut not limited to, inefficiency or theft, wilful damage to company property, assault and abusive conduct, serious neglect of duty and in such cases duty, fraud, sabotage, intoxication at work, refusing to carry out a lawful and 14.5.2 If an employee's services are terminated during the wages course of a week they shall be paid up all money due to them at the time termination of dismissal onlytheir services or such money shall be forwarded to them by post within twenty four (24) hours thereafter.

Notwithstanding the provisions provision of Clause 28.1.1 hereof, 13.1.1 hereof the employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or summary dismissal as provided by the Workplace Relations Act 1996 which is not limited to but includes neglect of duty duty, assault upon a client, visitor or fellow employee, proven instances of theft and in acts of wilful disobedience of a lawful and reasonable instruction from the employer (or delegate). In such cases the wages wage shall be paid up to the time of dismissal only.

Notwithstanding the provisions of Clause 28.1.1 hereof, in subclause 13.1 hereof the employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, dismissal including malingering, inefficiency or neglect of duty and absence from work without reasonable cause and in such cases the wages shall be paid up to the time of dismissal only.

Summary Dismissal. Notwithstanding the provisions of Clause 28.1.1 clause 15.1.1 hereof, the employer shall have the right to dismiss any employee without notice for conduct serious misconduct that justifies instant dismissal, including malingering, inefficiency or neglect of duty summary dismissal and in such cases the wages shall be paid up to the time of dismissal only.

Notwithstanding the provisions of Clause 28.1.1 hereofclause 2.2.1 herein, the an employer shall have the right to summarily dismiss any employee without notice for conduct that misconduct which justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases case the wages shall be paid up to the time of dismissal only.

Notwithstanding the provisions of Clause 28.1.1 hereof, the employer shall sub clause 11.1 above RDDT will have the right to dismiss any employee without notice for conduct that which justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases the wages shall will be paid up to the time of dismissal only.

Notwithstanding the provisions of Clause 28.1.1 clause 1.1 hereof, the employer shall have the right to dismiss any employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases the wages shall be paid up to the time of dismissal only.
