Common use of Substantial Completion Inspection Clause in Contracts

Substantial Completion Inspection. The University shall schedule an inspection to take place no later than seven (7) business days following the University’s receipt of the ESCO’s Notice of Substantial Completion and the submittals required by Section 7.3.3, to determine whether Substantial Completion of the work has been achieved. The Substantial Completion Inspection shall be conducted in accordance with the provisions of Section 5.15 herein and shall be attended by representatives of the ESCO and the University. In the event that the University has performed preliminary inspections of the work pursuant to Section 5.15, the Substantial Completion Inspection shall be limited to the inspection of work not previously inspected and previously approved by the University. It should be noted that prior to submission of a notice of substantial completion inspection to University, the ESCO shall have itself performed a thorough inspection, and created a punch-list containing incomplete or incorrectly completed items of work. The punch-list shall have been prepared by the ESCO and delivered to the University at least fifteen (15) business days prior to the scheduled date of the substantial completion inspection. Within fifteen (15) business days after the Substantial Completion Inspection is complete, the University shall either process the Substantial Completion package described in Section 7.3.4 hereof or give the ESCO written notice of all corrections required for the work to be substantially complete. If the University gives such notice to the ESCO, the ESCO shall have the right to submit another Notice of Substantial Completion to the University as soon as the ESCO has completed all corrections described in the University’s notice, and the University shall hold another Substantial Completion Inspection within fifteen (15) business days following receipt of ESCO’s notice that it has completed all such corrections.

Substantial Completion Inspection. When the Design-Builder considers that the entire Work is Substantially Complete, the Architect, Design-Builder, and Owner and Owner’s Representative shall inspect the Work. Based upon the Substantial Completion Inspection, the Owner shall prepare, coordinate, and submit to the Design-Builder a detailed list of all remaining Work to be completed or corrected in the Work (the Design-Builder’s Substantial Completion Punch List). The University Design- Builder’s Substantial Completion Punch List will identify all work necessary to be completed or corrected prior to issuance of the Substantial Completion Certificate, and the remaining items the Design-Builder shall schedule correct prior to Final Payment. The Design-Builder shall promptly correct all items listed on the Substantial Completion Inspection List as a condition to the Owner’s Certification of Substantial Completion. The Design-Builder shall notify Owner when all items in the Substantial Completion Punch List necessary for Substantial Completion are complete and correct, and request inspection by the Owner. The Owner will make an inspection to take place no later than seven (7) business days following determine whether the University’s receipt of the ESCO’s Notice of Substantial Completion and Punch List is complete. If the submittals required by Section 7.3.3Owner’s inspection discloses any item, to determine whether Substantial Completion of the work has been achieved. The Substantial Completion Inspection shall be conducted which is not sufficiently complete in accordance with the provisions Design-Build Documents so that the Owner can occupy or utilize the Work or designated portion thereof for its intended use, the Design-Builder shall, before issuance of Section 5.15 herein and the Certificate of Substantial Completion, complete or correct such item upon notification by the Owner. In such case, the Design- Builder shall then submit a request for another inspection by the Owner to determine Substantial Completion. After the second inspection, the Design-Builder shall be attended responsible for all costs incurred by representatives Owner to re-inspect the Work a third, fourth or more time to determine Substantial Completion, provided the re-inspection is due to Design- Builder’s fault. The Design-Builder’s obligation to complete all Work in accordance with the Design-Build Documents shall not be deemed waived, excused, or otherwise satisfied by any failure of the ESCO and the University. In the event that the University has performed preliminary inspections of the work pursuant any person or entity to Section 5.15include, the Substantial Completion Inspection shall be limited to the inspection of work not previously inspected and previously approved by the University. It should be noted that prior to submission of a notice of substantial completion inspection to Universitydiscover, the ESCO shall have itself performed a thorough inspection, and created a punch-list containing or identify any incomplete or incorrectly completed items of work. The punch-list shall have been prepared by the ESCO and delivered to the University at least fifteen (15) business days prior to the scheduled date of the substantial defective Work in any punch list, completion inspection. Within fifteen (15) business days after the Substantial Completion Inspection is completelist, the University shall either process the Substantial Completion package described in Section 7.3.4 hereof or give the ESCO written notice of all corrections required for the work to be substantially complete. If the University gives such notice to the ESCO, the ESCO shall have the right to submit another Notice of Substantial Completion to the University as soon as the ESCO has completed all corrections described in the University’s notice, and the University shall hold another Substantial Completion Inspection within fifteen (15) business days following receipt of ESCO’s notice that it has completed all such correctionsinspection report.
