Late on March 23, 2000, the majority of the Association\u2019s Board of Directors decided to recommend to its members that they defer the study sessions, and vote on the Government\u2019s proposed modifications to \u2587\u2587\u2587\u2587\u2019\u2587 recommendations: \u2022 Amendment to the Crown Counsel Act to recognize the Association as bargaining agent. \u2022 Acceptance of \u2587\u2587\u2587\u2587\u2019\u2587 recommendations as the process to be used for long-run negotiations with the proviso that the applicable Minister be the Minister responsible for the Public Service Employee Relations Commission. \u2022 Agreement to use \u2587\u2587\u2587 \u2587\u2587\u2587\u2587\u2587\u2587 to make non-binding recommendations to settle the immediate negotiations for the 1998 Agreement. \u2022 If the Government rejected \u2587\u2587\u2587\u2587\u2587\u2587\u2019\u2587 recommendations, then the Association could terminate the process, in which case the Government would be free to repeal the amendments to the Crown Counsel Act. The Association\u2019s membership rejected the Government\u2019s proposal in a vote taken on the morning of Friday, March 24, 2000. The Supreme Court heard the Government\u2019s injunction application that afternoon, but the judge reserved judgment until Monday. Over the weekend, the Government contacted the President of the Association, \u2587\u2587\u2587\u2587\u2587 \u2587\u2587\u2587\u2587\u2587\u2587\u2587, to see if another vote could be taken. She indicated that the Association would need something additional. The parties agreed to the following modifications: \u2022 The Minister responsible for accepting or rejecting the recommendations would be the Attorney General, not the Minister responsible for the Public Service Employee Relations Commission. \u2022 In the event that the Association opted out of the long-run process as a result of a rejection by the Government of \u2587\u2587\u2587 \u2587\u2587\u2587\u2587\u2587\u2587\u2019\u2587 recommendations for the 1998 Agreement, the Government would not repeal the amendments to the Crown Counsel Act. \u2022 The Government would acknowledge that the Association could lawfully strike if the parties did not reach agreement on the terms of the 1998 Agreement.16 In light of these modifications, the Association took another vote of its members on Sunday, March 23rd, which passed.
