Subs. 1 sentence 1 shall apply to the hours of work of crew members on watch duty on salvage vessels, as well as seagoing and salvage tugs, travelling the North Sea and Baltic Sea up to 61° North latitude. If the vessel is deployed at the scene of salvage, the hours of work, derogating from section 43, may be determined by the master, in particular taking account of the turn of the tide and of the weather.
Subs. 1 sentence 1 in Part 3 on the conditions of employment shall apply to self-employed persons subject to the proviso that the contract with the shipowner takes the place of the seafarer's employment agreement. Section 28 subs. 1 sentences 2 to 5, subs. 2 Numbers 1 to 5, 7, 9, 10, 12 and 13, subs. 3 Numbers 1 and 2, as well as section 29 subs. 1 sentences 3 and 4, shall apply accordingly subject to the same proviso.
Subs. (A) Subs’ Sole Purpose is to Enter into this Agreement. Since the date of its incorporation, neither Sub1 nor Sub2 has carried on any business or conducted any operations other than the execution of this Agreement, the performance of their obligations pursuant to this Agreement and matters ancillary to their obligations pursuant to this Agreement.
Subs by the Sale of Goods (Amendment) Ordinance, 1962 (47 of 1962), S.4 (with effect from the 7th June, 1962), for "bill of lading". Provided that, where a mercantile agent is, with the consent of the owner, in possession of the goods or of a document of title to the goods, any sale made by him, when acting in the ordinary course of business of a mercantile agent, shall be as valid as if he were expressly authorised by the owner of the goods to make the same; provided that the buyer acts in goods faith and has not at the time of the contract of sale notice that the seller has not authority to sell.
Subs. 1 to 5 shall apply mutatis mutandis to making amendments to major contractual terms and conditions. Sentence 1 shall not apply to an amendment of the statutory provisions, the collective bargaining agreements, works agreements or shipboard agreements applicable to the vocational training agreement.
Subs. 1 and 2 shall not apply to the persons designated in section 3 subs. 2 sentence 3. Section 90 Vocational training on ships of the Federation and the Länder Sections 81 to 89, as well as the legal ordinances handed down on the basis of section 92, shall apply mutatis mutandis if the vocational training is carried out on ships which fly a Land service flag or the Federal service flag and are deployed in maritime transport.
Subs. 5 Sentence 1 of the Profit and Loss Transfer Agreement is can- celled and reworded as follows: “The amount of the profit transfer shall become due one day after the approval of the annual financial statements.”
Subs. The District agrees to make every reasonable effort to have substitutes available for identified special education paraeducators in order to preserve the health and safety for students. The principal and/or special education administration will make the determination at the beginning of school year working in conjunction with the teacher and paraeducator if a substitute is needed.
Subs. (1) and (2) shall not prejudice the right of the Danish Energy Agency and the Licencee to agree, in any particular case, that a dispute as referred to in subs. (1) shall be resolved by arbitration.
