Sublease Rent. If the Tenant subleases the Premises to someone other than an Affiliate as defined below at a rent in excess of the rent reserved by the Owner hereunder, the Owner shall have the right to refuse consent thereto unless seventy five percent (75%) of such excess rent to be paid by the sublessee is agreed to be, and is, paid to the Owner and such condition is expressly agreed to be a reasonable limitation upon the Tenant’s right to sublease the Premises.
Sublease Rent. The original Tenant shall remain liable to the Landlord for all obligations under the Lease during the entire term of Sublet, including payment of all rent and other obligations under the Lease and liability for any damages to the apartment, even if caused by the Subtenant.
Sublease Rent. (a) Subtenant shall pay to Sublessor a fixed annual rent (the “Sublease Rent”) as follows: (i) for the period commencing on the Rent Commencement Date and ending on the last day of the month in which the fifth (5th) anniversary of the Rent Commencement Date shall occur (the “First Rent Period Expiration Date”), the Sublease Rent shall be payable at the rate of Three Million Twenty-Three Thousand Six Hundred Seventy-Four ($3,023,674.00) Dollars per annum and (ii) for the period commencing on the day after the First Rent Period Expiration Date and ending on the Expiration Date, the Sublease Rent shall be payable at the rate of Three Million One Hundred Ninety-Nine Thousand Four Hundred Sixty-Nine ($3,199,469.00) Dollars per annum. The Sublease Rent shall be payable in equal monthly installments, in advance on the first day of the month for which such rent is due. Notwithstanding the foregoing, Subtenant’s obligation to pay Sublease Rent shall not commence until the day (the “Rent Commencement Date”) which, subject to adjustment pursuant to the provisions of Article 3 hereof, shall be the day next following the three (3) month anniversary of the Commencement Date.
Sublease Rent. (a) In consideration of the lease of the Unit Interest, Home Owner shall pay to the Association rent of _Seven Hundred and Twenty Dollars ($720.00) per year, subject to increases, at the discretion of the Association, by an amount not to exceed eight percent (8%) of the previous year's rent, such increase to take effect as of each January 1st during the term of this Sublease. Unless otherwise agreed to by the Association, this rent is prorated in monthly installments and is included in the regular Association assessments. Payments for partial years and partial months shall be prorated. Any other amount payable by Home Owner to Association under the terms of this Sublease and any amount paid on behalf of Home Owner under Section 5.14, below, by The Regents, shall constitute additional rent.
Sublease Rent. Pursuant to Consent to Sublease Paragraph 7, Tenant and Subtenant acknowledge that seventy-five percent (75%) of all Excess Rent under the Sublease is owed to Master Landlord and Tenant hereby agrees to pay said Excess Rent to Master Landlord as due under said Sublease. Tenant and Subtenant represent and warrant to Master Landlord that: (1) the information shown on the attached Exhibit B “Summary of Amounts/Consideration to be Paid by Subtenant”, is based on information provided to Landlord by Tenant and accurately represents the amounts to be paid by Subtenant under said Sublease throughout the Sublease term; (2) no additional consideration is due Tenant under said Sublease, other than the additional consideration (if any) identified on Exhibit B; and (3) no further changes in the terms and/or conditions of said Sublease shall be made without Master Landlords prior written approval. The Excess Sublease Rent (if any) identified on Exhibit B has been or shall be paid by Tenant to Master Landlord on the first day of each month of the sublease term. Any Excess Sublease Rent due Landlord that is due and outstanding as of the date of Tenant’s execution of this Agreement shall be paid to Landlord concurrently with the return of this executed Agreement to Landlord. Tenant’s failure to submit any such payment to Landlord of the Excess Sublease Rent by the due date as stated herein shall be considered a default under the Master Lease. In addition to Tenant and Subtenant’s requirement to pay seventy-five percent (75%) of all Excess Sublease Rent to Landlord, Landlord acknowledges that Subtenant is paying a termination fee (“Termination Fee”) of $550,000.00 to iPass, Inc., and that said Termination Fee shall not be considered Excess Sublease Rent.
Sublease Rent. All monetary obligations of Subtenant to Sublandlord under the terms of this Sublease (including, without limitation, Base Rent, Direct Expenses, and Other Charges, but excluding the Security Deposit) are deemed to be rent (“Sublease Rent”). Sublease Rent shall be payable, without any deduction, offset, prior notice or demand (except as otherwise expressly provided herein), in lawful money of the United States to Sublandlord by ACH or wire transfer to an account that Sublandlord may designate in writing. Base Rent and Direct Expenses payable for any partial month during the Term shall be prorated on a daily basis based on the actual number of days in such month.

All payments shall be in the form of a check unless otherwise agreed by Sublessor, provided that payment by check shall not be deemed made if the check is not duly honored with good funds; provided, further, that if any such check is ever returned for lack of sufficient funds or is otherwise not duly honored with good funds, then Sublessor may thereafter require, upon written notice thereof to Sublessee, that all future payments of Rent or other charges under this Sublease be made in cash or cash equivalent mode. In addition to the Rent and any other sums or amounts required to be paid by Sublessee to Sublessor pursuant to this Sublease, Sublessee shall also pay to Sublessor, concurrently with the payments of said Rent or other charges, the amount of any applicable sales, use or excise tax, rent tax or other tax with respect thereto (other than any general income tax payable by Sublessor with respect thereto) as the same may be levied, imposed or assessed by any federal, state, county or municipal government entity or agency. Sublease Rent. During the term of this Sublease and commencing as of the Commencement Date, Sublessee shall pay to Sublessor as rent for the Sublease Premises the sum of Two Dollars ($2.00) per rentable square foot as "Base Rent" (as defined in Article 3 of the Master Lease) (the "Sublease Rent") pursuant to the terms and provisions of Article 3 of the Master Lease; provided, however, that Sublessee's obligation to pay Sublease Rent shall commence as of the Commencement Date and shall not xxxxx in any manner whatsoever (specifically, the terms and conditions of Section 3.2 of the Master Lease shall not apply to Sublessee's obligations to pay Sublease Rent) and Sublessee shall pay Sublessee's Share of the sums that would otherwise be payable by Sublessor under the Master Lease if the provisions of Section 3.2 of the Master Lease were not applicable.
