Common use of Subject to Sections 4 Clause in Contracts

Subject to Sections 4. 1 (a) and 4.1 (c), Insurer represents that it believes, in good faith, that the Contracts will be treated as annuity and life insurance contracts under applicable provisions of the Code and that it will make every effort to maintain such treatment. Insurer will notify the Fund and Distributor immediately upon having a reasonable basis for believing that any of the Contracts have ceased to be so treated or that they might not be so treated in the future.
